Well, if you want to live in many areas of the country, you are FORCED to have a HOA. This is not a choice and many don’t like it. Contract or not, FORCE is not your friend!

If your only reason to buy a house is for the investment value and not to create a home, then you have a point.
We purchased our property to make a home and would be fine with the value going down. That hasn’t happened in all the 40+ years we have been here, but I’d be happy if it did. Increasing value mean increased taxes. Yep. My taxes have increased every dang year.
Our acreage was purchased for a place to raise our children where they could be free to play ball outside, roam the woods, build a wood-fort, and have fun. . All without any interfering neighbors or power-hungry HOA board members who tell me how many vehicles I can own, where to park them, and what color I can paint my shutters.
When we were younger we had outside BBQs with all our friends and no one complained. My husband has several projects outside in various stages of completion, and no one complains.
Heck, before the children came along, we could take a blanket outside at night and make out in the moonlight and no one was around to see or care. (So THAT’s where those kids came from!).
There is no way I would try to establish a home in an HOA. THAT isn’t allowed.
But, if you buy a house with the plan to sell it in 5 years to make a profit, buying in a subdivision with an HOA is probably a good business plan.

It is the duty of the HOA to protect property values.
No they don't. Show me in the Constitution. YOUR rights do NOT trump my rights. I buy it, then I get to decide what I do with it and where to park my car, that is, if you live in a free society and not communist.

The HOA I was in, before it was disbanded, tried to use the Architectural Committee to limit the number of cars you could park on your property, tried to force me to sell my horses. would decide they didn’t like someone doing X and try to retroactively ban X. The HOA lawyer kept telling them they could not legally do those things.
When I was on the BOD, we told the Architectural Committee to turn over their files so we could review them. They refused. The HOA lawyer told them to hand them over or be fined. The records showed they would meet to discuss ways of screwing someone who offended them! The BOD fired every member of the committee, and then we started the process of eliminating the HOA.
When 90% of the homeowners vote to eliminate the HOA, you know the HOA was NOT looking out for the homeowners!
Our HOA protects against squatting. The owner and the renter have to go by the office and fill out a form listing who is actually living in the apartment and the automobiles parked there. So the “We have a lease!” scam won’t work.

AMEN. This is life. Back when the busybodies did not rule the world. Your kids could ride in the back of the pick up truck, and every pool had a diving board.
We already established that HOAs suck and are Communist. Get with the program.
HOA abuse is a virus and in places an epidemic.
If the general deed rastriction MUST be legally holding, giving an HOA certain rights, I would seek a law that (1) forces all HOA’s to rewrite all the HOA rules and restrictions, and all the new rules would have to be approved by not merely a majority of those voting, but a true majority of the residents within the HOA. I would also apply the same majority rule to who gets to sit on the HOA board and all future changes to any HOA rule.
HOAs operate as if they were small cities, without any real democracy in what they can do, yet the houses in them are (in mot cases) supposedly on land owned by the individual families (residents).
I’m about to sign off for the day and to answer some questions that will likely come up. Yes I think HOAs suck. Yes, I think they are Communist. Yes, I believe ANYONE who supports them is a closet communist.
No I am not trolling. I truly feel this way. Stop worrying about what your neighbors are doing and enjoy your own life or shut yourself away and be bitter then.
I truly have never understood why so many people feel the compulsive need to tell others how to live on their own property. I really don’t. I’ve said it before. IT IS NOT MY JOB TO PLEASE YOU WITH HOW I RUN MY HOUSE!
I think it is more a matter of the developer releasing the governing documents of the subdivision/development to another entity. I don’t believe it has to be an HOA. The requirements certainly don’t have to be Draconian.
I think HOA formation would be included in deed restrictions and covenants which are also filed in public record by the developer.

Ridiculous garbage...and many just ignore the HOA until something effects them...and then they actually read it.

That’s all well and house until the HOA, in conjunction with the owner developer, violate their own rules. That happened in the subdivision where we lived before moving here and why we moved.
They started mass building cheesy homes with square footage less than stipulated in the CC&Rs.
We’ve lived with HOAs, and without. Both can be very good and both can be terrible.
