Kentucky homeowner forced out of his own house by judge after squatter 'friends' moved into his garage - then refused to leave

A Kentucky homeowner was forced out of his house after his 'friends' moved into his garage while they fixed their broken-down car and then they refused to leave.

'I was just trying to be kind', said homeowner Daniel Toma after he allowed a friend, Amy Davis, and her boyfriend, Tyler Sencuk, into his home in Louisville, Kentucky.

The pair were visiting him during the summer when their car broke down. He offered his garage as a place for them to stay while they worked on it.

'Working on the car for days in the driveway, I didn't want to throw them out on the street. I was trying to be kind,' he said.

But in mid-July, the couple brought a mattress into the garage, set up a Spectrum box and then changed the locks. They eventually started getting mail and refused to leave, telling Toma they had 'squatter' rights.

Toma, however, received no rent payments, the couple had no lease, and the homeowner didn't want them there.

'I asked them to go, my roommates asked them to go, they wouldn't leave.'

'We tried to tell them to leave.'

Around Labor Day, Toma put up a 30-day eviction notice which further escalated tensions among the tenants.

Sencuk and one of Toma's roommates got into a fight, resulting in Sencuk filing for an emergency protective order against Toma.

Once this was granted, Toma was forced to stay 500 feet away from them or his house, reported Fox 19.

But rather than Sencuk being thrown out, Toma was told he had to go.

The protective order claimed Toma was Sencuk's roommate. He had told the judge he did pay rent in the form of 'maintenance' and the judge took his word for it.

the only way the American citizen will get true justice back is when the current crop of liberal judges join the thousand lawyers at the bottom of the sea. “elections have consequences and then everyone suffers the consequences” applies.

I agree….these people won’t stop and now they’re flat out just taking “our stuff”.. that’s when we start fighting back. I would not leave my own house and how this ruling became is beyond me.

Governor DeSantis in Florida recently tightened up the law concerning squatters rights. There are essentially no squatters rights in Florida.

Other governors should look at what the law is in Florida. How could anybody elect a governor who allows this kind of atrocity?

Anyone that uses the legal system to get you kicked out of your own home isn’t even an acquaintance much less a friend.

As the old saying goes, with friends like that who needs enemies.

We don’t have squatting problems in Florida anymore, as of July it’s been outlawed.....and why other states haven’t adopted this model is beyond me.

Gov DeSantis is excellent, but he is “only” the governor. He can only sign legislation after the legislature presents it to him.

So yes, it’s important to elect good governors. It’s just as important to elect good legislators.

Did they bribe the judge? What kind of idiocy is this? The owner of the home has a right to throw out someone who has no signed lease agreement with him. It’s that simple. Maybe we should drop these judges and let a citizen have the gavel for a day on a rotation basis.

I see a common misconception in this thread. Many have some idea that they actually own their property. Don’t pay your taxes/rent for three years and you will discover who actually owns our property. There is no such thing as private property. It all belongs to your local county overlords and government.

I used to love Ron Swanson memes.

But after “parks and recreation” was over he appeared in a short apocalyptic series, whose name I forget.

He played loner survivalist, who captured another stranger in one of his traps.

After letting the stranger stay in his home things change when they turn gay for each other and there is a long, maybe 20-second, full-on French kiss with tongue. I know they are actors playing parts, but it made me want to throw up.

I can never look at him the same way again. You could never pay me enough to ‘act’ in a scene like that.
