Alleged drunk driver who fatally struck Johnny Gaudreau, brother lets out exasperated sigh as he’s ordered held another week behind bars

The alleged drunk driver who fatally plowed down NHL star Johnny Gaudreau and his younger brother in southern New Jersey Thursday night appeared to sigh with exasperation when he learned he would be in jail through next week.

Sean Higgins, 43, was arraigned on two counts of second degree vehicle manslaughter by the Salem County Court at 1 p.m. Friday.

Judge Michael J. Silvanio ordered Higgins to be held until his detention hearing next Thursday, September 5.

Exactly. Plus, the two cyclists would have then maybe been seen by an unimpaired driver. This guy didn’t GAS.

I also know several long time motorcyclists who stopped riding because of distracted and DUI drivers.

I don't feel all that safe in my car. They don't go when the light is green. They're weaving. Some are very aggressive drivers. Most are doing something other than paying attention to their driving.

This guy killed two people. Two fathers. Two husbands. On the day of their sister’s wedding. One had a baby due in December.

I knew their Dad in college. He is one of the nicest people you will ever meet.

That entire family is devastated. A generation has been pretty much erased from them.

The driver, if he was drinking, has no excuse. He deserves to feel some pain; but nothing will come close to the pain he has caused.

This is why I never bicycle on a public road. Bike paths are bad enough.

Yeah, I used to ride my bike on the road quite a bit. I eventually decided the risk wasn't worth it. Treadmill for me now.

John and Matthew’s father,Guy coached a whole generation of youth hockey. I use to watch both of them play when my nephew played under Coach Guy. Such a crying shame. Prayers to the family.

I’ve read that an estimated one in ten people have some amount of sociopathy. They have little or no empathy for others. It’s theorized that this trait has some survival advantage. A sociopath is willing to drink up all the remaining water in a lifeboat. Or he’ll be the one to easily kill raiders attacking his village. Non-sociopaths may be willing to assist in violence once it’s initiated, but they almost never initiate the violence to protect the village themselves. In today’s world, unless you’re a soldier there’s little or no use for a sociopath. In today’s context they’re bad. An inordinate number of successful CEO’s would score high on the sociopath spectrum. This guy is probably also high on that spectrum.

Can’t post the comment I really want to make, because as a cyclist on FR, I’ll get flamed to the rafters. Waiting for the usual suspects to show up, once they realize the victims were cycling when they were killed. They’ll be blamed for their own deaths, then called names, like spandex-wearing faggots in tight pants or something.

I am a civil engineer by trade, and this tragic incident illustrates the single biggest reason why I will never sign off on a transportation plan or street design that accommodates bicyclists and motor vehicles on the same roadway.

Virtually all non-highway roads allow bicyclists. It does not need to be signed off by an engineer. I assume you're referring to bike lanes on roads. If local ordinances permit bike lanes, and in many cases mandate them, as part of new construction I'm curious how you have the discretion not to sign off on them if they meet design standards?

In an interview with police, Higgins explained that he was traveling north in a Jeep Grand Cherokee behind a sedan and an SUV, the criminal complaint obtained by The Post said.

He tried to pass the slower-moving cars by moving into the southbound lanes, the authorities explained.

Higgins passed the sedan and tried to reenter the northbound lanes when the SUV in front of him moved into the middle of the roadway in order to safely pass the bicyclists on the right side of the road.

Higgins then tried to move past the SUV on the right, and struck the brothers from behind, troopers said.

He told police that he believed that SUV was preventing him from passing, and that his alcohol consumption exacerbated his frustration and lack of patience.

Yep after 3 decades and a lot of miles on 4 motorcycles, I sold the last one to increase my chances of staying alive.

Back in 2001, my brother, who was a contract pilot flying for the Washington Corp. out of Montana, was on a layover after flying the corp. owner to southern California.

He was doing some sight seeing in a rental vehicle when his car was hit broadside while driving thru an intersection by a 19 year old Hispanic kid who was high on drugs and alcohol and ran thru the red light, killing my brother Scott.

The kid, Cruz Alejandro Martinez, only got 4 years in prison.

From all the information I have gathered over the years, I now firmly believe that Martinez was likely an illegal before illegals were an actual problem.

The guy is guilty of a crime, two of them no doubt, but the bike riders at 8PM??? On a road, stupid. The other guys following instead of passing, the SUV only moved left to cut him off, else he would had moved left when the drunk driver moved left, or sooner. He is also culpable as it is logical he was blocking the drunk from passing.

Were the two cars part of the family, or following the bikes for some reason?

There is a lot more to this story I surmise.

I truly love cycling, but roads are too dangerous. A lot of cyclists are suicidal clymers. I was watching FOX25, local Fox affiliate in Boston, with my wife, and they had a story about a young women cycling who had a very minor incident with a car, captured on a dash cam. The cyclist ran into the rear of a car that was slowing down as it was approaching a rotary (round about), and fell, but did not suffer any injuries. It appeared to be completely the cyclist's fault. The auto driver did not stop, and I am not sure that I blame him. The news reader was blaming the motorist. Surprisingly, the cyclist was the daughter of a professor at a local Ivy, so they had a media APB out for the motorist.

Even on a bike path there is a problem with heterogenous populations. Some bikers think they are on the Tour de France and slash in and out and between run-of-the-mill bikers. Others are out of shape and veer left and right, as you are trying to overtake. A real problem where I go is E-bikes. I suppose they are okay for older folks (I'm 73), but when some inconsiderate out of shape jerk cruises by at 30 mph, expecting all and sundry to get out of his way, it's a hazard.

Personally, I sail along at about 15 mph, slow down when approaching slower groups (sometimes with little kids) try to give as much deference to others abilities as possible. If you want to or insist on going 45, ride at first light when no one else is there. It you need an e-bike, and like the sunshine and fresh air, keep it down to about 10 or 15 mph.

And for God's sake, obey traffic laws.

I really believe all people under the voluntary influence of a recreational mind altering drug must be held responsible for what they do as “premeditated.”

Without a doubt, they chose to lose control. Whatever they therefore do, becomes premeditated.

If you kill someone under such influence, you have committed premeditated murder—period.
