Vanity: Can Biden legally get off state's ballots?

Watching the news this morning and discussion of the possibility of Biden dropping out, a former congressman (Chafitz) brought up an interesting point.

Biden is on state's ballots. Primaries have been held and the dye is set. There is not a slot for Democrats (or Republican) and they can not add or drop as they need.

At this point in the election process, the only way one can get off the ballot is to die. (Cafitz' point)

Biden has to stay on the ballot as a place holder if for no other reason.

Interesting point. There are many here who are very well versed in the election process. Is Cahfitz' point correct?

My thought is, if so, it will take a challenge of state's election rules to replace him on ballots OR a massive write-in campaign.

He’s not the actual candidate unless The DNC sent his name to the states after their so called virtual convention which they held to beat Ohio’s deadline.

The democrat party is private and can make their own rules. Biden can release his delegates and they can vote for whomever they want.

If he does not release his delegates, they are required to vote for him on the first ballot. It is no more complicated than that.

This is how nominees were selected 60 and 70 years ago. Primaries only started in the 1960s.

States include the nominee of the party - it does not matter who it is. They are not independent candidates and those folks have different rules to follow.

The Rat’s (DNC) back in 1972 removed Senator Tom Eggleton from the VP nominee’s slot post-convention when word got out, he had been treated for depression. That should give some guidance in reading the tea leaves of what might be next. Have they changed their rules since then? However, with Rats what’s a rule but something to be broken when its inconvenient!

Strange variant of "the die is cast," but I suppose that it's possible.

the nominees’ names are listed for the convenience of the voter, but whether the name can be changed or not on the ballot has no effect on who gets elected in the contest, the slate of electors get elected.

The nominee's name is on the ballot, but that's just a convenience for the ballot's sake. The voter is voting for Electors to the Electoral College.

What makes it doubly bad is that originally, they were voting for known leaders in the state who would serve as Electors and then make a conscientious choice when the time came to vote in the Electoral College.

Today, we're actually voting for who gets to pick the Electors. It's not even clear to me that the "slate" of Electors is finalized before voting takes place in November. I think the parties have ways of swapping out one Elector for another up until the Electoral College actually meets to vote.

Imagine if we had to actually vote for each Elector individually? Personally, I'd love to see a state like California with 54 Electoral College votes try to run an Election where two or three people per Electoral College spot run for the position in each Congressional district. Take off the name of the candidate and run the names of the non-government officials who want to become an Elector.

They did it for Toricelli, they can do it for Biden.

Torricelli was running for a defined seat that had a direct election.

Voting for President is indirect. We are actually voting for Electors to the Electoral College.

Biden has not yet been officially nominated. Consequently, the ballot line for the Democratic Party presidential nominee remains subject to change.

Many states have deadlines for filing as a candidate. Those deadlines have all passed. How can the DNC name someone who has not filed as a candidate?

It does not matter. Those are really votes for delegates to the convention.

I predict it will all be worked out before the next news cycle. One way or another, the fix will be in for the replacement.
