NYC woman, 93, left with no money despite owning a 10-unit Brooklyn building, family claims

A Brooklyn immigrant’s $4 million nest egg is off-limits when she needs it most during her final years because of ineffective court-appointed guardians, her family contends.

Aleksandra Chodowiec, 93, arrived in the U.S. from her native Wroclaw in western Poland by herself in 1973 at the age of 43. She worked two jobs, in an envelope factory and cleaning Manhattan offices.

In just two years, the industrious Chodowiec saved enough dough to purchase what should have been a golden ticket: a five-story rental building with eight apartments and two commercial units in Greenpoint.

Yep, he let the property deteriorate while he got paid first then wants to sell said property, probably to a buddy, and rack up even more legal fees while the old woman sits in souled diapers

Where there’s a will, there’s a relative.

It is rare to find a group of extended relatives without the inevitable greedy grasper who can’t wait for the principal to die off so they can cheat all the rest of the relatives out of a fair share.

God bless this woman. Because they expect a windfall, they are even complaining about buying her diapers. What would they have done if she had not been propertied, thrown her in the street?

the usual racket is that the family court judge appoints a relative or good friend as guardian, and the guardian kicks back some of the skimmed money to the judge. it’s a common
“adult protective services” scheme and it can come into play when relatives cannot come to an agreement before the case gets to court. for the adult being “protected,” it can often be a one way street until he or she is bled dry financially.

In the last year, as a real estate investor, I’ve helped two families in a similar situation with estate owners having dementia and an evil step child taking legal control of the estate. It’s critical that, when making wills, a directive be spelled out who will be POA and what is to be done with the estate and/or trust. Ultimately, with my friends, it’s none of my business but they would rather just walk away from it all.

How about an evil not-step-child? I know of one family with 7 siblings, one of which is a mentally disabled female (agoraphobia) where one evil sibling conned the now deceased mother to put his name onto the deed of the house and make him executor of the estate with no signed will. The will never got signed with him as executor, because it didn’t say what he wanted it to say (that he gets everything). Now... he is threatening to sell the house out from under the disabled female sibling... after he has confiscated and kept ALL the money the deceased mother had in her accounts. Oh... and this probably isn’t pertinent, but the evil sibling is also GAY. Nah. No connection to the evil probably.

The elder woman’s affairs became subject to a state guardianship proceeding in 2018, after a family dispute erupted over Chodowiec’s care, records show.

The article doesn't say, but I will assume even if she had a will, she did not create a revocable living trust (or a living will for health-care decisions), or appoint trustees to manage this property in the event of her incapacitation. She may not have thought of it, never sought legal advice, or her children are untrustworthy in some regard, or some combination of all these thigns.

the IQ of Government is equal to that of its lowest member - so if at all possible, you do not want to leave any decisions to be made by a Probate Court, or the people it appoints. Even with the best intentions (which is a gamble in America's 21st century, corrupt, back-scratching, cronyist government) they are still bureaucrats who will work at their own schedule, pace, and terms.

It is hard once you get involved and see the $hit that goes on. This happens every day, countless times.

I do my best, but it is hard not to get sucked into it. I am working on that now.

Thank you, Dac... and it's so true. I just hate to see greedy family members go all out to take advantage of their own elders. Unfortunately, it's usually the boys (I refuse to call them "men"). The one I'm working on now is really tragic! I can't post about it yet because it's somewhat public and involves a murder of an estate owner. Sure enough, the black sheep loser and estranged son comes swooping in out of nowhere to claim admin rights. I'm not an attorney, so it will be one for the law books if my legal objection holds him at bay.

I think most court appointed guardians need a court appointed inspector that checks up on the guardian’s actions, can rescind those actions, can force actions, and can be official interlocuter betwen the guardian and any family membes of the person for whom they are the guardian.

Unchecked by anyone else officially, there is too much court appointed guardians can get away with before lengthy and costly court processes can get them removed. Only if their authority can be officially checked by someone else can their activities be forced to be transparent and just.
