Credit card... no problem, if the credit card company is notified in timely fashion. Debit card... a little less certain.

I visit Kinston quite a bit to look after my best friend’s father. It is a very wholesome town and everyone there is very sweet and mostly unworldly (in a sweet way) - it is quite shielded from the evils of the world. It is my experience that most people there do the right thing and wouldn’t believe that people would steal a cc number. Good BBQ at Kings and The Beef and the Baron is just awesome for steaks, their salad bar and you meet everyone in line!

Unless the Cafe owners want VERY Bad publicity(and they likely already have it), they’ll be paying this lady’s credit card bill.

A second mistake:

*NEVER* say ‘No comment’ (or take the 5th, or say ‘on the advice of my lawyer I say nothing’).

“No Comment” = “I’m guilty as sin, don’t care, and F-U”.

The only acceptable response in the 21st century is to take FULL responsibility immediately, state clearly what you *HAVE DONE* (not ‘are going to do’) to completely rectify the situation, state that the employee involved has been fired, list what your are doing to recompense the wronged party, and do all of these before the second post hits Facebook, X, or twitter.

Taking more than 10 minutes to completely rectify a gaffe such as this is suicide for all but the very largest corporation.

I guess I was “lucky” when the waitress just took the numbers of me and everyone else at the table and probably sold them privately rather than tell everyone. When I saw 5 charges at a Walmart in Maryland I shut down the card right away. The next week I found out that everyone at the table had their number stolen.

Even the company issuing a debit card would not require her to pay these charges, if only because they have a slam dunk subrogation claim against the diner. As long as they can collect from somebody, they’ll be happy.

This does not make sense as I thought that the credit card companies are responsible for fraudulent purchases. And they should be considering the fact that they allow anyone to used someone else’s credit card. No genuine signature verification even required.

And if people paid in cash, this would never have happened.

I get an instant notification by e-mail and text if my credit card is used. Like seconds after it’s run.
