A man in Florida has been charged with battery after he threw his Subway sandwich at an employee because it had not been cut into two pieces.
Alberto De Barros ordered a sandwich at a Subway in Stuart, Florida on Tuesday, Jan. 9, but was "upset" with the sandwich artist upon discovering that the sandwich had not been sliced in half.
According to a probable cause affidavit, Cassandra Tia Pierre-Louis, the employee, told De Barros that she would no longer be serving him after he "began causing a disruptive scene."
Rather than walk away, the 54-year-old decided the right thing to do was throw his sandwich at Pierre-Louis. De Barros then left the restaurant but, Pierre-Louis followed him outside and photographed his license plate.
De Barros was eventually tracked down by police and admitted that he was "upset over his sandwich not being cut" but said he meant to hit the counter with his sandwich instead of Pierre-Louis.
However, store surveillance showed De Barros picking up the sandwich and throwing it at the employee. De Barros was arrested and charged with battery.
After posting a $1,000 bond, De Barros was released from custody at the Martin County jail. He is scheduled for an arraignment on Feb. 1.

If this hot headed dumb @$$ would have asked the clerk “Would you please be so kind and cut it in half” I am sure the clerk would have been delighted to oblige.

The patron lost any right to complain the moment he walked into Subway.
They are just bread guys hamming it up and couldn’t cut the mustard as they are strictly a paint by the numbers intellect.
Still, as a “so called artist” Hunter Biden could ketchup and besides, he’s in a real pickle these days .....

Yes. The normal thing to do but I suspect that neither of the two were very well versed in the language they should be - English.

Simply standing in someone’s way and deliberately blocking his forward progress can constitute “assault”.
Any deliberate contact with another person, whether with one’s own body or with some object, can constitute “battery”.
In this instance, the “battery” would be of the misdemeanor variety.
