On Nicolle Wallace's show yesterday, Luttig once again played the role of a useful conservative propounding views destined to delight the left. He declared that the decision of the Colorado Supreme Court banning Donald Trump from the ballot, supposedly pursuant to the terms of the 14th Amendment, to be: "a masterful judicial opinion. It is unassailable and irrefutable in every single respect."

You could sense liberal hearts swooning from coast to coast!

And in a statement that was either deeply naive or deeply cynical, Luttig said of of the Colorado court's decision:

"This is not politics. It is certainly not partisan politics. And the Supreme Court's decision yesterday was not a political decision in any sense of that word."

I’m old enough to remember when a person had to be convicted before being punished. There was a presumption of innocence.

Also old enough to remember when there was a thing called criminal jurisdiction. How can Colorado convict a person whose alleged actions were in Washington, D.C.?

Section III of the 14th Amendment is pretty clear that it only applies to those convicted of insurrection. Neither Trump nor any of the J6 defendants have been charged or convicted of insurrection, so how is this ruling:

It would appear Luttig is unfamiliar with the Constitution and is a legal buffoon.

Luttig reminds me of Rod Steiger’s character in the movie Dr. Zhivago who starts out under the tsars as a supporter of the tsarist regime who does a lot of business with them and after the Red Communists takeover, he is one of the regional Red commissars. To paraphrase Zhivago, “he was on all sides of the same fence”.
