On July 31, U.S. District Judge Maame Ewusi-Mensah Frimpong denied the motion to dismiss the lawsuit in a 20-page letter, saying that customers "could believe — erroneously — that the products originated in Texas."
"Though it is true that the imagery of the solo white star and lassoing caricature are not exclusive to the state of Texas, taking the imagery and text of the label as a whole, this argument does not discount the possibility that a reasonable consumer would believe that the products are based in or originate from Texas."
The class action lawsuit, filed on September 12, 2022, by Phillip White, claimed that he purchased a bottle of Texas Pete hot sauce for about $3 at a Los Angeles supermarket, believing it was produced in Texas, according to the complaint.

After learning the hot sauce was made in Winston-Salem, North Carolina, he claimed the company was using false advertising. He further claimed that he would not have bought the bottle or paid as much for it if he had known where it was produced.
"By way of its false marketing and labeling, [Texas Pete] knowingly and intentionally capitalizes on consumers’ desire to partake in the culture and authentic cuisine of one of the most prideful states in America," the complaint alleges.

Texas Pete is a.... character, a person who came from Texas to NC with a recipe. Simple and there is no brand from Texas that is hurt by this sauce. The sauce is nothing like any sauce truly from Texians. Quite popular in Texas NC and all over the country.
Don’t know who is bringing suit, but this reminds of the “case” presented on ABC by Sam Donaldson against a Salisbury, NC based grocery which was damaged by “hygeine” issues, depressed in value and then acquired by DelHaize company of Belgium (see: InBev)— now called Food Lion. And it is much more crappy a store than the one ABC helped destroy.

Mcllhenny Co. Avery Island, LA. An American company for over 150 years which uses... Tabasco peppers in the recipe. Ferments them in wooden barrels (which, when opened on the tour of the kitchens— can swell people’s eyelids... the concentrated fermenting hot pepper and juice it is in.
A wonderful American product. As is Texas Pete— made with simple cayenne.

What varietal? Commercially raised a sterile hybrid pepper of a cross of green pepper with Jalapeno. Great flavour, and they had no—zero heat. Branded as “Fooled You!” Good and Foolish Bread and Butter Peppers.
You could take one- red matured looking just like a Jalapeno- and munch down in front of very impressed friends.
Pickled in bread & butter sweet (with a little hot) liquid.
