Maryellen Noreika Issues New Order (Friday) After ‘Apparent Misrepresentations’ Before Hunter Biden Plea Deal Imploded

Delaware U.S. District Judge Maryellen Noreika issued an order Friday to prevent “apparent misrepresentations” related to the Hunter Biden case.

Noreika’s order instructs that all issues with the Hunter Biden case be brought directly to her rather than the Clerk’s Office in order to prevent potential “misrepresentations” in the future.

“I have already discussed my concerns about apparent misrepresentations made to a member of this Court’s Clerk’s Office,” the order reads. “In addition to that, in a submission addressing those apparent misrepresentations, counsel for the House Ways and Means Committee needlessly included on the public docket an email from a Clerk’s Office staff member that contained her personal contact information.”

“THEREFORE, IT IS HEREBY ORDERED that, going forward, any issues or inquiries in the above-captioned cases shall be brought to my attention and not to the Clerk’s Office. Any such issues and inquiries shall be submitted in writing and placed on the docket,” the order concludes.

Prior to Biden’s court appearance, a member of Biden’s legal team allegedly “misrepresented her identity” during a call with the Clerk’s Office about an amicus filing by a Republican lawmaker, causing Noreika to threaten sanctions for Biden’s legal team.

Noreika said Latham & Watkins LLP staffer Jessica Bengals represented herself as someone who worked with Theodore Kittila, the attorney for the House Ways & Means Committee in a call to the Clerk’s Office.

Republican Missouri Rep. Jason Smith, Chairman of the House Ways & Means Committee, issued an amicus brief Tuesday asking the judge to consider testimony from two IRS whistleblowers showing “political interference” in the Hunter Biden investigation.

Understand. That may well be the case, but its incumbent on the judge in a high profile case like this to make damn sure everything is done right and to avoid errors at all costs. Some things just require extra management attention. She should know that.

I once worked in a very large project that was under intense scrutiny. The project manager frequently reminded us to perform at an exemplary level. What was left unsaid wasn’t necessary to say.

The paragraph above in the article which was excerpted out points out that Latham & Watkins LLP is one of Biden’s lawyers.

Prior to Biden’s court appearance, a member of Biden’s legal team allegedly “misrepresented her identity” during a call with the Clerk’s Office about an amicus filing by a Republican lawmaker, causing Noreika to threaten sanctions for Biden’s legal team.

Noreika said Latham & Watkins LLP staffer Jessica Bengals represented herself as someone who worked with Theodore Kittila, the attorney for the House Ways & Means Committee in a call to the Clerk’s Office.

This should be referred for criminal prosecution, but it won’t be. And as others noted Delaware is a small town so everyone knows everyone. I assume Jessica Bengals is a DC staffer so she was not known in Delaware.

The judge has her own law clerks. She does NOT run the clerk’s office. There are many judges.
To some extent the District Court and chief judge supervise the clerk’s office but the clerks are federal civil servants.
This days nothing about the judge’s supervisory abilities. That’s why she now ordered that all Communications come through her chambers not the clerks office.

Websites are not always updated upon termination. And she is a New York based attorney and not just some random staffer as I first thouht.

Empty threat obviously. I don’t know how legal/ethical matters like this are typically handled but it seems egregious enough to warrant some type of punitive actions.

I understand your points. It may be more difficult for noreika to impose her will on the clerks in a matrix management civil servant situation. These guys punch in at 9, punch out at 5, and maybe even take a 90 minute lunch hour. They don’t answer to a particular judge.

This being Delaware, they are perhaps already geared towards the white collar corporate criminal elements, and perhaps Hunter is just one of many “friends” that they “help” when the need arises.

The kids need college, the beach house and the summer Europe vacation needs to be paid for, etc.

Norieka is in a rough spot. If she leans too hard on the court clerk staff, she alienated them and also some or all of her peer judges in that courthouse. This is a side effect of evil— it begets more evil. Every time someone overreaches, the remaining honest people get squeezed a little bit more.

This sounds a bit like a “since you can’t do it I will” type of response. That’s no way to fix an impactful problem like this.

Allowing something like this to happen during a very high profile case is suggestive of a process breakdown. Notwithstanding the judge’s supervisory abilities, a breakdown like this is also suggestive of a lack of respect for the complete integrity of the judge’s duties, which are under intense scrutiny. Sometimes you just have to make sure things work right, and this was one of them.

Actually noreika used a somewhat passive voice and did not accuse any particular individual, at least in this filing (maybe in di-12). If it’s not in di-12 then perhaps the title slightly overstates noreika’s position on the matter.

The email in question was from the lawyer for the House Ways and Means committee and contained an email that divulged the court clerk's personal email, apparently not her work email. Federal employees are prohibited from using their personal email for government business (Hillary? Anyone?) except under very narrow exceptions, and they must copy or forward the email to their government account under the Federal records act. For instance, two Air Force employees cannot discuss offers from Lockheed and Raytheon on their private email, since in the event of a challenge of an award, all government records concerning the award are subject to discovery.

What Hillary did, running her Secretary of State's office out of a private email account was a playground for corruption and abuse, which is why those emails will never see the light of day. What is even worse, or weirder is that Huma Abedin used her sicko husband Anthony Weiner's laptop and left the entire mess there for the FBI to find. But never divulge.

I am under the impression that the court has some discretion as to whether or not to accept any given amicus brief for filing. If so discretion may be shared between the presiding judge and the clerk staff. Maybe a real lawyer can comment on this.

I get what you’re saying. And I’ve worked in matrix situations. Some of those managers demanded more respect and more of your time than others. You quickly learn which managers you have to toe the line with and those you have more slack with. Noreika may have been in the latter category. I don’t know, just a possible explanation to your question.

I have a feeling this is NOT the end of the story.

That person, Bengels, instead of perp walked, the Biden attorneys will give a medal and a parade.
