They probably could have won the case against Fox, since it clearly falls under the “fair use” exception to copyright law.
However, they likely don’t have the resources to match Fox in the lawfare department, and could be bankrupted before they’d win the case.

Also, there is plenty of BLM riot footage that wasn’t taken by Fox (or purchased by them). Aldean’s people could probably reach out to independent journalists on twitter that were covering the riots (like Andy Ngo) and ask them for permission to use their footage.
