They probably could have won the case against Fox, since it clearly falls under the “fair use” exception to copyright law.
However, they likely don’t have the resources to match Fox in the lawfare department, and could be bankrupted before they’d win the case.

For me, whether words or video all “news” reports enter the public domain and need no “request to use” as long as attribution is given or implicit in the material. If the video was clearly represented as a Fox news video, then legally no other attribution was needed, in my view.
