Burger King ordered to pay whopping $8M to man who fell on ‘foreign substance’

A Burger King franchisee in Florida, was ordered to pay nearly $8 million to a customer who allegedly slipped and fell at the restaurant and needed surgery for his injuries.

Richard Tulecki, 48, “suffered lower back injuries resulting in surgery” after he slipped on a “foreign substance” near the restroom of a Burger King location in Hollywood, Fla., according to court documents.

The fall caused “serious injuries” which required surgery, and Tulecki suffered a postoperative perforated colon, according to his attorneys.

The lawsuit, filed in January 2021, accused Burger King of negligence for “failing to ensure that the area and floor of the business was free and clear of any hazards.”

A Broward County jury awarded Tulecki $7.8 million in damages, including $3.35 million for lost earnings and $700,000 for medical expenses.

A sigh of annoyance can be heard from Wal-Mart, who is sued roughly once EVERY DAY, most of which are bogus slip-and-falls. And Wal-Mart has a no-settlement policy, so they have a battalion of lawyers, and cameras in their stores are ubiquitous.

And their lawyers are very practiced in such lawsuits. Since usually those thinking to get rich quick from a settlement are poor, it is not worth their while to counter-sue, and even their litigious lawyers are small fry not worth the effort.

$3.35 mil...if he worked to 62, that would be more than a quarter of a million for 14 years.

I don’t do chains often, but if I have to choose, I like Culver’s burgers. My fave is always my hubby’s pecan-smoked ones.

He was 46 at the time of the suit. Figure 20 years of work. I guess he was clearing $175,000 per year.

My professional and liability insurance skyrocketed two years ago. I asked my agent what was going on.
