Erick Aguirre, 29, was arrested north of Corpus Christi, Texas Tuesday, the New York Times reported. He is charged in connection with the April 11 death of 46-year-old Elliot Nix in Houston. He was jailed on a $200,000 bond after an arraignment Thursday.
Aguirre and his date, Melanie Castillo, arrived in separate cars for a date at a restaurant called the Rodeo Goat on the night of the shooting, according to the Times.
Once they parked, a man approached them to pay a $20 parking fee each car. Aguirre paid, and the couple went on to the restaurant. When they got to the Rodeo Goat, a worker told them the seeming parking attendant was actually a "scammer."
Castillo, who voluntarily gave a statement to police two days after the shooting, reportedly said Aguirre "sprinted" back to the cars while she waited outside the restaurant.
A witness from a nearby smoke shop told police he saw Aguirre pull a pistol from his car. Next, he heard a gunshot, saw Aguirre return to the car with the gun, then saw Aguirre go back to Rodeo Goat, according to the Times' review of court documents.
Castillo, the woman on the date, said Aguirre told her he "just scared the guy." The pair went inside the restaurant, only to leave shortly after when Aguirre suggested going someplace else.
"She was devastated to learn of the death," Castillo's attorney, Rock DeToto, told the Times. He added that Castillo was "shocked to see a photo of herself on the news and to hear that she was a person of interest."
"The penal code in Texas, and in 49 other states, and in most civilized countries, doesn’t give you any legal basis to shoot and kill someone who ripped you off," legal analyst Brian Wice told KPRC.

It’s also ‘always been’ that murder is a capital offense... especially so in Texas.
We’llllll we’ll just see how this plays out. Maybe the scammer went after him, etc. His lawyer will probably weigh in soon. Like maybe he got the gun because he was headerd to confront the criminal, and they guy grabbed at it on that old dark parking lot.
And then of course, you have to get all 12 jurors to agree.
And just any old murder doesn’t get you death. It’s gotta be in the process of doing another felony, or a cop, etc. They call those special circumstances.
It’ll doubtful be life, or death. Anyway, I am not rooting for him to walk just yet. But I do see the humor in what he did.

I really have to scrape hard to find sympathy for thieves and con men, or any thug, these days. Especially since our government seems more concerned about protecting and coddling, and in some cases, encouraging them, nowadays.

It is a defense of prosecution to use deadly force if someone is stealing from you in Texas.

Unfortunately, that is modern FR. A growing number of silly people who don’t consider the fact that a person who would kill a man over $40 is most probably a BIGGER criminal than a parking lot scammer. Someone who can switch-on to kill mode that quickly is either a gangbanger of sorts, or someone with extremely limited (and dangerous) impulse control.
All you need to do is look at FR posts from 10-15-20 years ago, and compare them with most posts nowadays.
The politics of Democratic Underground fortunately haven’t taken root here (we are still for small government - for now although that has been slowly changing towards larger government, God, liberty, the Constitution, etc), but the stupidity of DU most definitely took root!

No, not at all. Please do not put words into my mouth. My point is that when lesser crimes are ignored, really bad things can happen down the road. It’s the “broken windows” theory.
Rudy Giuliani understood all that when he was mayor of New York. And so he was able to clean up the town.

Proportionality for starters. If a guy punches you wife you punch him. If a guy kills your wife you kill him.
