Yes, he’s got a problem with that “immediately” bit, but he could try to argue that he pursued the thief immediately after learning it was a theft. Weak, and I don’t think a jury would buy it....but wasn’t my point.

Texas law absolutely does allow deadly force in defense of property, including mere theft, albeit during nighttime hours. A stretch to apply that here, but the statement on its face is incorrect.
