NYC garage worker charged with attempted murder after shooting armed thief

A New York City parking garage attendant was hit with an attempted murder charge after confronting an armed thief and wrestling the gun away before opening fire on the suspect.

Moussa Diarra, 57, is also charged with assault and criminal possession of a weapon in connection with the incident that occurred at around 5:30 a.m. Saturday morning.

The attendant had observed a man looking into cars on the second floor of the West 31st Street garage in Manhattan, police said, according to the New York Post. Diarra suspected the man was stealing, so he brought him outside and questioned him about what was inside his bag.

The man then pulled a gun on Diarra, who attempted to grab the firearm. The gun was fired, leaving Diarra with a shot to the stomach and grazed in the ear by a bullet.

Diarra proceeded to turn the firearm on the potential thief and shot him in the chest.

The alleged thief, 59-year-old Charles Rhodie, was also charged with attempted murder, assault and criminal possession of a weapon. He also faces a burglary charge, police said.

Diarra and Rhodie were transported to Bellevue Hospital in stable condition after Saturday's incident at the parking garage.

The charges against Diarra for defending himself against an attacker come after a similar incident last year. In July, Manhattan bodega clerk Jose Alba was charged with murder after a confrontation in the store with an angry customer who attacked him behind his counter. Alba stabbed and killed the attacker in self-defense but found himself at the Rikers Island jail charged with murder.

Just in case you didn’t think NY could be any more f’d up.

Charged for attempted murder after being shot twice by the perp and charged for with assault and criminal possession of a weapon - for using the perp’s gun to defend himself.

According to the story, the perp was charged with the same charges. Makes sense, since they were both doing their respective jogs. The garage attendant was monitoring and protecting the cars in the garage and the perp was doing his job, breaking into cars, stealing and shooting innocent victims.

On a side note, this is coming from the same District Attorney’s office of Alvin Bragg that is officially arraigning DJT on Tuesday.

Now it all adds up.

To each and every New Yorker (and of course, non New Yorkers) who voted for this vile piece of crap, you DESERVE whatever happens to you . . .

Diarra is the victim. Is that who is being charged?

I’m going to suppose the DA’s theory is that once the victim got the gun he was no longer in danger. Therefore, he was attempting to murder the assailant who was at that point disarmed and not a danger. (This is why I have shooter’s insurance.)

If you’ve already been seriously injured, you don’t know if you are about to pass out. You don’t know if you are already, effectively dead. Killing your attacker is the only way to successfully disengage should you be on the edge of fainting. Trust me on this, you won’t know you’re on the edge until it is too late.

The way this works is the DA will plead the case down so that the victim does time. But he’ll have to admit he was attempting to commit murder to get the deal. The DA gets to hang his scalp on his political ladder. Being a DA is usually a steppingstone in politics. If the victim gets a public defender, he’s likely going to lose the case.

Well, I guess Charles Rhodie is a more protected species than Moussa Diarra.
That happens in countries with different tiers of justus.

Boy Howdy! if only Moussa Diarra was gay or transgender, that might have put him to the head of the list.

I’m in Florida. Before Governor Bush signed The Castle Doctrine bill Floridians had a duty to retreat. That meant that if you were being approached by a man wielding a machete and you had a gun, you had a duty to retreat. Only if you could not retreat were you allowed to shoot the attacker. There were many cases where the defender did retreat but ultimately fired. The prosecution would argue the defender did not try hard enough to retreat. I even read where a prosecutor asked why the defender didn’t just shoot the weapon from the attacker’s hand. (Yes, some people are really that stupid.)
