A pregnant Florida woman charged with fatally shooting a mother of three in an Uber last year is arguing to be let out of jail because her unborn child hasn’t committed a crime.
In an unusual legal argument, attorneys for Natalia Harrell, 24, filed a motion on behalf of her fetus, asserting that it shouldn’t be behind bars without being charged with an offense.
“The State has placed the unborn child in such inherently dangerous environment by placing the unborn child in close proximity to violent criminal offenders,” the filing asserts.
Harrell’s child, it argues, is receiving inadequate pre-natal care and is unlawfully being locked up.
The case contends that the fetus should be released pending trial — which would necessarily get Harrell, who is facing a second-degree murder rap, out of jail.
New video released last week showed the moment she fatally blasted mom of three Yvette Borcela inside an Uber in which they were traveling with five other people after a night of partying in Miami last July.
Harrell’s attorney, William Norris, asserts his client shot Borcela, 28, because she lunged at her during the argument and that she feared for the safety of her baby.

Throw the weeotch in to solitary, for the rest of her pregnancy. Give her a window seat, for Vit D…along with her 3 hots/cot.
Place the baby up for immediate adoption. God help that baby.
She really cared so much about her baby inside of her she was out partying in Miami at night! Did they do a blood test to see if she was under the influence that night? Either way they baby is probably safer behind bars that out cruising the strip with baby momma. And no matter where they put her the baby will still be around at least one dangerous criminal, her mom!
The evil logic of women.
Kids are always just exploitable props, only useful forwhatever benefit they provide you.
They are people when you want to get out of jail or steal from a mans wallet for 18 years
They aren’t people when you want to murder them for your convenience
All the while ducking personal responsibility and playing victim
I agree, the baby should not be forced to serve time with the mother against their will.
A creative and novel argument.
Stick her head between the jail bars and leave the baby on the outside
The victim was innocent and didn’t deserve to be shot.
Sad how everyone emptied out of the car. I hope one of them had the decency to call the paramedics.
When the baby is born, that can be arranged.
How about charging her fetus as an accessory to murder. Case closed.
Bet she voted rat last time she could.
“Sorry the clump of cells stays in jail with you”
Thos will be interesting. Isn’t a baby just a parasitic lump of cells? What side will the abortion lovers come down on?
You think a dumb t**t like that would take time out to vote? That would take away from her hair and nails and sex and selfies. She ain’t got no time for that.
Surprise! Bet no one could guess the perp’s skin color was black.
Stupid entitled slob.
Satans followers ...always looking for excuses! Get ready to burn in Hell in the end!
Oh the irony!!
Think about that statement for a moment and think about who the baby is with 24/7 no matter where she is.
otoh she is not in prison, did she just call people facing a court date already guilty?
do I even have to look to figure out what type of person this twisted drivel came from?
She should have thought of that before killing someone.
Besides,, I’m sure there are plenty of people who would be willing to adopt that poor baby.
It will be interesting to see how this plays out, because here she is appealing to the baby’s innocence, and yet if she had wanted and abortion, she could kill IT with impunity, and no risk of consequences.
The irony……..
That poor baby is already in close proximity to a violent criminal offender.
