A six-year-old boy who shot and wounded his teacher constantly swore at staff, tried to whip other students with his belt and once choked another teacher 'until she couldn't breathe', a lawyer has claimed.
The incidents were described in a notice sent to the Newport News school district by Diane Toscano, a lawyer for teacher Abby Zwerner who was shot by the same boy earlier this year.
The lawyer informed the district that Ms Zwerner intends to sue.
Ms Zwerner had just finished reading a story to her class, who were about to head to an art lesson, when the six-year-old pulled out a handgun and shot her on January 6.
The notice of claim outlines the boy's behavioral issues, and troubling interactions he had with teachers and fellow pupils at Richneck Elementary School in Virginia.
Two days before the shooting, the six-year-old allegedly 'slammed' Ms Zwerner's mobile phone and broke it, according to the claim notice.
He was given a one-day suspension, but when he returned to Ms Zwerner's class the following day, he pulled a 9mm handgun out of his pocket and shot her while she sat at a reading table, the notice says.
The document says that several hours before the shooting, at least three teachers and staff members warned school administrators they believed the boy had brought a gun to school.
His backpack was searched, but no gun was found, and administrators did not remove the boy from class, lock down the school or call police.
The claim notice says Ms Zwerner went to former assistant principal Ebony Parker's office at about 11.15am that day 'to advise her that the shooter seemed more 'off' than usual and was in a violent mood'.

Sounds like he had a keeper than parents because parents let kids act like that.
“once choked another teacher ‘until she couldn’t breathe’”
Did the teacher try, I don’t know, standing upright?
Think of what that kid personally suffered to learn to act out those violent attacks
Unless he was just born as a psychopath and
Terrorized by a six-year old.
Well yeah. If a teacher raised their hand to defend themselves from the holy terror, or a White student for that matter. The members of the media would make sure that they never got out of jail.
I was thinking more if a six year olds’ size versus an adult. Maybe the adults were sitting in chairs.
These horrorshow kids were put away in state homes when you were young.
And the behavioral problems were sent to training schools, with uniforms and taught a trade and socialized.
We now mainstream these horrors instead of putting them away so they are protected and the publics are protected.
RE: constantly swore at staff, tried to whip other students with his belt and once choked another teacher ‘until she couldn’t breathe’
In other words, no one at school or home thought anything was out of the ordinary. Or possibly “”Sort of kept to himself.”
They obviously had very serious concern to do that.
I still can't believe nobody noticed a 9 mm handgun stuffed into a 6 year old child's pocket that is probably not even big enough to hold a handful of...well, pocket change.
True. Lawsuits would be filed before the lawyers finished their $150 lunch.
The lack of spanking and discipline because we don’t want to hurt their little feelings is endangering others. They need discipline, as do the parents.
The school superintendent who was “in charge” at the time was “let go”. Parting gift was two years salary at $250,000 per year.
I’ll risk saying this: This kid was born bad. He should have been “disappeared” a long time ago.
The kid is 6. They aren’t large at all at 6.
An adult woman can still wring their little necks. Hell even screaming loudly and angrily at them can make them pee themselves.
Could have been.
Learned behavior at home & I bet an IPad with violent video games is his babysitter.
Kid sounds like a good candidate for an exorcism.
There are some six year olds that are down right scary
This kid was bad enough he was supposed to have a parent attend school with him
“...several hours before the shooting, at least three teachers and staff members warned school administrators they believed the boy had brought a gun to school.”
What we have here...is a failure...to communicate.
