A Washington DC woman is suing her neighbor because says the marijuana smoke coming from his apartment has 'invaded her home' and is ruining her life.
Josefa Ippolito-Shepherd, 76, is suing the District of Columbia over the smell coming from neighbor Thomas Cackett, 73, which she says has made it hard for her to breathe, sleep and live.
'I have the right to breathe fresh air in my home,' Ippolito-Shepherd said. 'I'm not talking about if I go to someone else's house or a place people go to smoke pot. They have the freedom to do whatever. I just do not want to be invaded in my own home.'
Ippolito-Shepherd - who claims she will never move from her home of 30 years - is asking the city to ban smoking in multi-unit buildings. Recreational marijuana is legal in Washington DC, meaning the smoker isn't committing any criminal offense.

IF smoking is illegal, then ALL SMOKING is illegal. I’ve seen people repeatedly saying that it is okay to smoke pot in non-smoking areas, that it is legal, different, etc.
This is just one of the hundreds of reasons why I will only live in a single family home.
Durian really sucks. I don’t let it my house.
Gotta tell ya, I’m tiring of smelling skunk AND their smoke everywhere I go, including entering the air vent on my car as I drive.
It was this crowd which made my life hell when I was hooked on the cancer sticks and currently makes it prohibitively difficult to even enjoy a cigar indoors/out of the weather.
If I have to smell skunk without any due process - which, hypocritically, is required of any other odorous endeavor, such as livestock, pigs, etc. - then it’s far past time that regulations catch up with these hypocrite asshats.

Indeed visit Los Angeles it’s like seeing monkeys on sugar rush.
Since she is representing herself, one hopes the legal proceedings will be a one-and-done — no countersuits or harassment from the other parties.
Even if she loses, she can better spend the money on a contractor to stuff the cracks that allow the smoke into her place, since her landlord won’t do it.
If she wins, she can compel him to do it and pay for it.
Long-term renting, however, has become a very dicey proposition in the law-suit happy U.S. Long-timers can feel all dug-in, but they are in jeopardy year to year.
There is some skanky azz weed out there. He’s probably destroying his lungs. I have a vape unit that doesn’t smell like anything really. It doesn’t get you very high either so there is that. It was a gift from my kids for being the grower.
She should go get an air cleaner.

We had 1 guy light up a joint in the 36 unit courtyard apt building I am at and it really stunk up the whole place.
He never did it again and thankfully moved out.
I hate when a joint stinks the joint up. 🙂
