Florida repair tech accused of saving copy of explicit video from customer’s phone

PORT CHARLOTTE, Fla. — A repair technician working on a Florida woman’s phone found an “explicit video” among her files and made a copy for himself, authorities said.

According to a news release from the Charlotte County Sheriff’s Office, Cody Austin Terry, 28, of North Port, was arrested on Monday. He was charged with accessing a computer or electronic device without authority, WINK-TV reported.

According to the sheriff’s office, the victim took her iPhone to an I-Fix store in Port Charlotte and left it with the suspect for approximately two hours to be repaired. Deputies allege that Terry browsed the woman’s files and discovered an explicit video saved to the device. Terry then allegedly texted the file to his phone, the sheriff’s office said.

The next day, the victim discovered the sent text message and noticed the video had been deleted from her device, the sheriff’s office said. She made a report to the sheriff’s office, and detectives traced the text to Terry’s phone, The Miami Herald reported.

After speaking with a detective, Terry allegedly agreed to allow a search of his phone, the sheriff’s office said. He also allegedly guided the investigator to a hidden file on his phone where the video was located.

Terry also signed a waiver to allow deputies to download the contents of his phone. They verified that the file had been sent from the victim’s phone number while the device was in for repairs, deputies said.

So he was authorized.

I’m sure this happens all the time, but rarely is a tech so dumb as to leave an easily traced trail. And deleting the original - dude, a real pro move.

This kind of stuff happens all the time. The FBI pays bounties to computer repair people who find illicit material. Many of them run forensic software to look for it. It probably flagged the video. Don’t give your device to anyone you don’t personally know and trust.

Access to repair the phone isn't the same as permission to copy and distribute. Similarly if I give a valet keys to my car it is to park it, it is not giving permission to take it out for a joyride.

It is questionable whether this would be legal if the repair tech took ownership of the phone for non-payment like was done with Hunter Biden's phone. Does ownership only apply to the hardware or to the data too?

And somebody told me to take my Android phone 📱 to an I-Fix store.

Phone can’t be booted. Software corruption. But I don’t want the phone wiped. Like with a cloth.

But there’s nothing significant on it. Some games I want to save.

THe law says unauthorized access to a computer or device.

She authorized him to access it to repair it.

You hire a plumber, yes, they are inside your pipes.Here, they’s basically sharing the guy with illegal pipe access. See how that’s a problem?

They can write a new law and make up a new crime but ‘someone did something bad’ doesn’t make it an actual crime.

Was he a lowlife perv to do that? Sure. Go write a law to cover it.

Always amazing how ‘conservatives’ are quick to give the power to the State that belongs to the people. Look at what the DOJ is now doing with ‘disinformation’ to completely control 1st Amendment rights on social media.

“Well, the law says...” The law says whatever interpretation they make up for it.

Police / DOJ / etc. are out to abuse their power and they have to follow the strict limits of our Constitution.
