Trump Organization Tax Case -explanation needed. (Vanity)

I am having a difficult time understanding the case that was adjudicated today. The press doesn’t really say anything.

What are the crimes the company was charged with? Tax fraud is awful broad. What are the specific charges?

Is this a New York tax code case? If it is federal, why is it in a New York Court and not a federal? I’ve never heard of a tax case being decided by a jury. I thought tax court had a trial judge. If this is really about taxes, whether state or federal, how can a jury review anything that complicated in less than a day? If it is a very complicated fraud case, as most fraud cases are, and the jury decided in less than a day, doesn’t that mean the jury didn’t deliberate? Certainly the judge directed them to review the evidence. It’s obvious they could not have done that. Isn’t that grounds for dismissal or at least a mistrial?

I noticed that the Fox News lackey was all over the fact that the Trump Derangement goons finally destroyed President Trump as if he was toast and we’ll never hear from him again.

It is actually a fairly simple case about reporting of benefits. If the benefits were not reported, there is a problem. If the benefits were reported, then not a problem.

The Jury basicly said that the organization did not follow the law with regards to reporting benefits to the IRS during the company tax filing. Those benefits are treated as income.

Still, we’re it a tax case, why was the prosecution conducted by the Manhattan District Attorney and the New York State Attorney General and not the US District Attorney? This sounds more like a federal case than a state case.

The same thing happened to me during my 30 year stint with ATT. For years I would get free swag from the company for various reasons. A free hat for some anniversary or a T shirt for some course I took. about 15 years before I retired I started to get a W-2 form with $10-$20 on it. I called to find out what it was for and they said it was for the free swag. I said I don't want the crap, but they said it was mandatory.

So for 15 or so years I counted the W-2 form to avoid an audit. I've still got hats I've never worn at 71 yo. I always wondered if the supervisors had to count their fishing trips and hunting trips and pay taxes on the young women that accompanied the trips. They were allowed to drive company vehicles with company insurance,...just because. I never found out if my retirement dinner with 6 friends was charged to me or not. It was explained that the boss gets money allowed for retirement dinners in his company expensing.

These companies that worked for Trump were just found guilty for what everybody and their brother does every day with selective enforcement.

I believe it was federal, but filed in the New York district courts, a pretty hostile venue to Trump.

The laws get a bit muddy on stuff like that because the trips could be classed as an “entertainment expense” on the books, as long as they invite a potential client along or something like that. Then the IRS would not look at that as a benefit to the employees on the trip, but rather as part of their job duties, while the company can still deduct it as a legitimate business expense. Not sure how the company cars are handled, I never had to do accounting for that and I’m not a CPA, just picked up some bookkeeping on the job.

The specifics are that Trump staff were allowed to live in unsold units of Trump buildings.

It’s basically the boss being nice and letting his staff us an empty unit for a few months and not forcing them to pay the large amounts of tax on a multi-million dollar property.

It’s really not a -simple- case of “benefits”. They were calling it a benefit if a car was sent to get someone. It was them criminalizing several small things in the workplace they deemed a “benefit”. Meanwhile leftist companies inundate employees in wine and food bars, massages, ubers etc etc... and it’s suddenly not a benefit when they do it.

This was a dishonest case, brought to a dishonest jury, for political retribution. They literally started investigating their target to see what they could find. We are beyond rule of law.

So what if Trump invited some top performers or other employees he wanted to favor to Mar-A-Lago for dinner or for the weekend.

Do those have to be treated as "income" too?

Except the IRS had nothing to do with the case. This was a New York State case, not a Federal case.

Sheesh. How many times do I have to tell you? It is the National Transportation Safety Commission (NTSC), which I retired from after 32 years of service. LoL!!!
