After reading the article ( I know it’s unusual) It seems like the dealership and country club are both pointing fingers at each other. If the Dealership knew the advertising was for a free truck, they they should not have provided the display.
The man fulfilled his obligation. He will get the truck..................

I’ve hosted numerous golf tournaments and purchased insurance to cover the hole in one prizes. And it was incredibly inexpensive insurance IIRC.

I suppose you can argue they defrauded him of his $375.00 for the tournament fee, but I don’t know if that is “major fraud”.

Yes, it is major fraud when you add up the $375.00 for each player.

They promised the keys, not the truck. Give him the keys.
Then tow the truck away and change the locks.

If this case is being litigated as a fraud claim, then the defendant(s) may be facing the prospect of paying the following (depending on the laws of the state):
1. the cost of the truck ($54,000)
2. their own legal fees to defend themselves in the lawsuit
3. triple damages (for fraud)
4. the plaintiff's legal fees
5. punitive damages
This can turn into a $500,000 loss very easily. And if they lose a fraud case, it's not covered by insurance, either.

PR nightmare? Post what happened on “Next Door” There are an awful lot of people who read these posts and then vent outrage and boycott these businesses.

Isn’t this Major Fraud, a Felony to boot?? No, just potentially breach of contract depending on what the facts actually show.

I have a friend this happened to. They placed the truck on the wrong and shorter hole. There’s insurance purchased by the car dealer in case there’s an ace. So a multi party lawsuit.

give him a hot wheels version of it. The keys don't go with the toy truck.

3. triple damages (for fraud)
4. the plaintiff's legal fees
5. punitive damages Those awards are not going to happen. It's a simple breach of contract case. The plaintiff gets the amount of damages suffered as a result of the breach (here, the truck or its value) and the defendant pays the award and its own attorney fees.

Had 2 hole in one last year with many people witnessing. In tournament you buy a million dollar policy just in case it happens. $300 premium for one day event. Sounds like someone forgot to buy insurance.

My date in college went with me to a 3 par chip-n-put course on a date night. Cheap fun date to drink cheap beer. My date teed up on the first hole and hit it in from about 50 yards.
I married her quickly. Been 40 years now.
