Missouri Senator Josh Hawley Introduces Bill to Give States the Power to Deport Illegal Aliens

The “Empowering States to Deport Illegal Immigrants Act” would grant state and local law enforcement officers the power to carry out certain federal immigration laws. This legislative proposal was introduced at a time when the Biden regime is doing everything possible to undermine border security.

The bill would effectively nullify a 2012 Supreme Court decision which significantly hamstrung states’ ability to enforce immigration laws.

The aim of Hawley’s bill is to give states the power to deploy their resources for immigration enforcement.

Seeing that Democrats believe they have a Constitutional loophole to flood the country with votes oops, I mean people, do you think this legislation would pass Constitutional muster?

Have no idea.

Is there anyone out there with legal expertise who can tell if this will win a court challenge? The Democrats will take this to the courts for sure since they would never win in the legislature.

So, if the Federal Government refuses to enforce our laws then can the states do it for them?

If the answer is no, then the Federal Government can invite an invasion and there is essentially nothing anyone can do about it.

In the same vein if the Federal Government refuses to enforce other laws, say civil rights laws, interstate sex trafficking laws, drug laws, etc. then there is nothing we can do about it. Just sit and take it.

Surely there are some checks on Federal power?

It’s a great idea but we need a lawyer or someone with legal experience to tell us if the proposed legislation will get past court challenges.

Enough with selective enforcement of the law.

In the future, I am going to start referring to the ILLEGAL ALIENS as illegal alien voters, or immigrant voters, or something like that.

Did Hawley try to do this when Trump was president?

GOPers have a penchant for proposing significant changes ONLY when they are in the minority and know that nothing will come of it...

I overheard a guy at lunch who was saying it takes too long to become a citizen.

He said a year at most.

Normally if you marry an American it is about 5 years if all your paperwork is filed on time.

Most nations require a lot more commitment.

One year as this guy thought is ridiculous, five years a minimum. Maybe at least ten years with a legally-acquired green card is ideal.

Giving him the benefit of the doubt it wasn’t a problem under President Trump. Perhaps he did not forsee the problem, but then again neither did I. This is worse than under Odinga.

Not a lawyer.

The case some years ago, when AZ was actually assisting the Feds with their purported immig. duties (and were sued) established that Immig. is the exclusive purview of the Feds. With what I know today, I have to doubt this bill goes anywhere.

If the feds aren't gonna do their job, he can start with asking his state to stop assisting the feds in the enforcement of federal laws.

As it is, every state has a right to prevent invasion. Hordes of illegals in a state is a invasion. All states have failed in their duty to do that.

Not only that, but nothing prevents Sen. Hawley to push for the impeachment of the president for not enforcing current law and protecting the border and country.

This is merely republican politics in front of a camera, or to get their name out. Republicans sold out decades ago on immigration and protecting this country. Don't expect anything from them.

So FedGov can invite an invasion. Great. Perhaps the framers of the Constitution could not envision such a traitorous party.

If we form a different union this issue must be addressed. AND we would need to be able to throw out areas unsuitable for human habitation...New Orleans, Memphis, Jackson, St. Louis, Detroit, etc.

Funny thing, of all the founding documents I have seen, of every country, there is never a mechanism to throw a troublesome place out. Why? Honestly. Why?

The issue is federal preemption of immigration law. Congress can change the law and permit the states to enforce those laws. Arrests and deportations must still comply with constitution due process, etc.
