(2010) It’s a Tish-grace! Councilwoman Letitia James sues over scratch

Councilwoman Letitia James has filed a personal injury suit against an itinerant laborer after she allegedly injured herself walking into his legally parked truck.

The Democratic lawmaker, who makes $122,500 a year as the people’s representative in Fort Greene and Clinton Hill, is seeking an unspecified amount of damages for wounds she claims to have sustained on July 11 when she walked into a four-inch trailer hitch protruding from David Day’s parked car.

James sustained “serious, severe and permanent [injuries] to her limbs and body” and “she will be caused to suffer … continuous pain and inconvenience,” according to court papers filed last month in Brooklyn Supreme Court by James’s attorney Robert Mijuca of the powerful law firm of Rubenstein and Rynecki.

The court documents also allege that the injuries caused James to be unable to attend to her usual occupation - though the alleged pain and suffering occurred on the eve of the councilwoman’s re-election campaign, one that she waged with her typical vigor against two primary rivals.

She bounced to an easy victory. Additionally, several of James’s Council colleagues told this newspaper that they did not recall James limping or using crutches during the summer.

But court papers paint a very different scenario of the events of July 11 on Fulton Street between S. Portland Avenue and S. Oxford Street.

The lawsuit claims that James “came into contact with the exposed, unprotected hitch,” contact that led to “great physical and mental pain” — though the actual body part that was damaged is not cited.

James claims that Day’s hitch is illegal and that her injuries resulted “solely [from] the careless and negligent manner in which [he] owned and maintained his motor vehicle.”

The only trailer hitch I have walked into was my own. Man, it can be a real shin burner. I guess I could have sued myself.

Learned my lesson, I always remove the hitch an ball as soon as I am done with it.

I agree. I walked into one, and cut my shin pretty badly, and as I cursed, I wasn’t cursing the truck, the hitch, or owner, I was cursing myself for my carelessness.

Well, that’s not wholly true-I did curse that hitch mightily, but that lasted for all of about two seconds. Boy, did that hurt.

The dummy walked into a parked vehicle. The dummy thought it would move? The dummy thought the inanimate object would somehow acknowledge her big fat ass coming and in abject fear become a sentient being flea in horror of this dummy crashing into it?

This dummy in NY is an opportunist. The dummy doesn’t know that abusing the legal system (suing someone because you walked into their trailer hitch) or abusing your position (suing someone for personal political gain) are not actions of a person of honor and respect. They’re actions of a dummy, a white collar thug.

I like many others in my life time have walked into a trailer hitch. Never thought to sue anyone for my carelessness.

Reminds me of being in the jury selection process for a civil trial. The judge relayed the particulars of the case where the female plaintiff said she went to a doctor’s office, and when entering the examination room, bumped herself against the examination table.

I listened for the judge to relay more. Perhaps she then tumbled onto a tray of carelessly placed scalpels? What was the complaint other than her own clumsiness?

But no; that was it. She herself bumped into the edge of the examination table and now she was suing the doctor. Such an absurd case. Glad I was ultimately *not* selected for the jury.

Same here. A lot of posters on this thread seem to have missed that the story is dated 2010. The case must have been resolved by now.

And if you use it every day, or two or three times a day?

Plus if it's on a car and not a bumper hitch, it's probably bolted to the car's frame and doesn't come off.

Of course, if used 2-3 times a day that makes sense.
I use mine twice a month.
Mine has a 2” receiver. Pull the pin. Out slides the ball. Throw it in the back. Done.
