The release of the FBI's Mar-a-Lago affidavit could further damage Trump's defense, legal experts say

Former President Donald Trump has repeatedly and publicly called for the release of an FBI affidavit that formed the basis of the bureau's search of his Mar-a-Lago club and private residence. On Thursday, a federal judge granted Trump's request, ordering the release of a redacted version of the affidavit.

But legal and national-security experts say the former president should be careful what he wishes for and that the document's release could land him in more hot water.

Magistrate Judge Bruce Reinhart ruled that the Justice Department must file a redacted version of the affidavit to the public docket by noon ET on Friday. But he agreed to keep under seal parts of the affidavit that could reveal:

The identities of witnesses, law enforcement personnel, and uncharged parties

The strategy, direction, and scope of the department's investigation into Trump's handling of government documents

Sources and methods

Grand jury information

But even with those redactions, experts say, the document could still reveal key information about events leading up to the FBI's unprecedented search of the former president's home that could be damaging to him.

John Dean, who served as Richard Nixon's White House counsel and later became the star witness in Congress' Watergate investigation, told CNN that he "can't imagine that Trump is going to be happy with this document, given the fact it was an advocacy document written to persuade the judge to find probable cause to undertake a search."

The FBI's search warrant showed that investigators believed Trump may have violated three US laws, including the Espionage Act, when he moved government records from the White House to Mar-a-Lago upon leaving the presidency and then resisted turning them back over.

I have news for Yahoo news.

ANYTHING damaging about Trump would have already been released. The pattern of leaks in the government, lies by Congresspeople like Pelosi and Schiff, cover-ups by the DOJ and FBI, and fake investigations like Mueller, and setups by multiple Government agencies, have all been out in the media on Day One. The Truth has always taken years to acquire, and it always has been that Trump was honest and the Government was dirty.

The Judge will redact anything that makes the FBI/DOJ and the Biden administration looked corrupt in the concern of “protecting the Government case”. When the United States was a Republic, we always gave the defendant reasonable doubt of guilt and full access to all materials for defense. Over and over the FBI has withheld Brady material from defendants, the last being the drone footage from Kyle Rittenhouse.

Law is pretty clear president has total and unilateral authority when it comes to classification. The USSC has already ruled on it... and Obama actually implemented “presidential orders” in 2009 that basically said the president is not binding to any laws or regulations related to classification, but he detailed out those processes for people lower than president. Bush II also did the same in 2001..

The president records act also had not ramification or anything that you can be charged with. Its an administrative process that is meant to direction negotiations with former presidents and NARA.... Obama did take 30 million documents (NARA confirmed it), and millions more were classified and being stored in a facility in DC....

Tell us which GSA employee packed the TOP SECRET - SCI documents in the boxes knowing that the documents were classified. Let’s start with that right there. The problem is that most people do not know that the media and DNC are lying their faces off to make this believable to the public.
