Judge rules abortions can continue in Kentucky while lawsuit is considered

LOUISVILLE, Ky. —

A Kentucky judge has granted a request to block the enforcement of abortion bans amid a lawsuit.

That means abortions in Kentucky continue to be legal for now.

The ACLU, Planned Parenthood and EMW Clinic in Louisville filed a lawsuit after a sweeping abortion ban went into effect across the state triggered by the Supreme Court's decision to overturn Roe v. Wade.

The groups were granted a temporary restraining order to halt the ban last month by Jefferson County Judge Mitch Perry.

Friday's ruling, also by Perry, is a temporary injunction that will keep abortions legal at least until the lawsuit is resolved.

Read the ruling here.

Kentucky is one of at least 13 that had a "trigger law" in place when Roe v. Wade was overturned in late June.

The constitutional protections for abortion had been in place for nearly 50 years.

When it was overturned, that trigger law made nearly all abortions immediately illegal in the commonwealth. The very limited instances where they would be legal would be to prevent death or serious injury of the person giving birth.

Only two places in Kentucky currently provide abortions. Both are in Louisville and are the two facilities that are part of the lawsuit.

Attorney General Daniel Cameron has been fighting to end the emergency order. He responded to Friday's ruling, calling it disappointing.

He said, in part, "We will continue our steadfast defense of these bipartisan laws that represent the commonwealth's commitment to the lives of the unborn."

This is not one of those times where it is a good thing that our legislature cannot call itself into session.

The ending of a life is not reversible. All of the innocent children killed cannot be brought back to life even if we prevail in this lawsuit or pass the constitutional amendment in November.

Sound law IMO so long as serious injury is limited to "life-threatening injury".

With those ending three words can anyone deny our culture is under attack?

Under what grounds does the judge have the authority to suspend state law?

As far as I know Kentucky is down to one operating abortion clinic. So, while this Jefferson County commie pisses me off, I know he is going to lose and there is not much baby killing going one while we wait for that to happen. Yes, I know any is bad, but this is where we are.

Stop surrendering natural rights and the authority of legislatures to judges.

Judges are not kings.

Judges are not gods.
