California to allow private lawsuits against gun ban violators in swipe at Texas law

TO: California Governor Gavin Newsom in Los Angeles SACRAMENTO, Calif. (Reuters) - California Governor Gavin Newsom on Friday signed a law that would allow private citizens to sue people who sell, manufacture or distribute assault weapons and guns made at home to avoid tracing.

The law is a swipe at a Texas law that allows individuals to sue anyone who helps a woman obtain an illegal abortion in the state.

Newsom, a Democrat who has been mentioned as a possible presidential contender, signed the California legislation on the same day he released an ad in Texas criticizing the state's reproductive rights policies.

"If Texas is going to use this legal framework to essentially outlaw abortion and harm women, all with the Supreme Courtโ€™s blessing, California is going to use it to save lives and take AR-15s off our streets,โ€ said State Senator Robert Hertzberg, a Democrat who co-authored the bill.

Newsom has pushed for the law since last year, when the U.S. Supreme Court upheld the Texas law allowing the vigilante-style lawsuits.

"Our message to the criminals spreading illegal weapons in California is simple: you have no safe harbor here in the Golden State," Newsom, who signed the bill in Santa Monica, said in a news release. "California will use every tool at its disposal to save lives, especially in the face of an increasingly extreme Supreme Court.โ€

In the ad placed in Texas newspapers, Newsom showed an anti-abortion quote by Republican Governor Greg Abbott that said abortion cost children their "right to life."

Newsom replaced the word abortion with phrase "gun violence," changing the meaning of the quote to assert that gun violence was killing children rather than abortion.

He said new California legislation was the state's answer to "Texas' perverse bill that placed bounties on doctors and patients."

Interesting you should say that, I’ve always thought that there’s something about Maxine Waters that reminded me of the aliens in that movie. I can kind of see it with Gavin Newsome now.

Sounds like the Gov. and legislature of CA are using their instruments of governance as a substitute for a twitter account.

Apparently they feel too inadequate to go on twitter itself to express their feelings.

You can sue.a company incorporated or headquartered in another state if they meet one of two criteria in the state initiating the litigation. One have a business presence in the litigious state no matter how small a physical presence. Two have a substantial business income sourced in the litigious state. As in do you mail order or internet ship into that state. This is well established legal.precedence used for tax code enforcement at the state and federal levels. California is using the what is good for the goose is good for the gander legal establishment. The USSC upheld a nearly identical law at the Federal level so California is on fairly strong standing. It already is a state jail felony on California to import “assault weapons” you have to go through a California based FFL this applies to individuals who travel out of state and returns with an prohibited weapon get caught in California with that imported weapon and they will put you in state jail for it. The USSC has not stopped California in that regard yet so they will keep doing it till they have an injunction against them.

California is a one party state (with a lap dog media) they can pass any crazy legislation they can think of without any opposition. There are no check and balances in California.

If the Constitution prohibits you from doing what you want, turn it over to the BROWN SHIRTS they will carry out your orders.

As long as the issue is included in the Lawful trade in Arms fedlaw, does anyone in state civil court have a leg to stand on? An illegal (sic) weapon per CA law is another thing.

Would be interesting to know.
