Supreme Court may soon expand gun rights amid roiling debate

The Supreme Court will soon issue its first major Second Amendment opinion in more than a decade, coming after a pair of recent mass shootings sent the nation reeling and reignited a tense debate over gun rights and public safety.

The conservative majority court is expected to rule in the coming days or weeks in a pending dispute over New York state’s tight limits on the concealed carry of handguns.

Experts said that while it’s unclear just how broadly the Supreme Court would rule, the restrictive New York law is likely to be invalidated in a decision that could have ramifications for gun control efforts across the country.

“It does seem relatively clear that the court is going to strike down New York’s law and make it harder for cities and states to restrict concealed carry of firearms,” said Adam Winkler, a professor at UCLA School of Law. “It remains to be seen exactly how broad the Supreme Court goes, but one thing is clear: as mass shootings become more of a political issue, the court is going to take options away from lawmakers on the basis of the Second Amendment.”

The justices are expected to hand down an opinion as soon as next week but no later than late June or early July.

As they deliberate, the U.S. is again engaged in a wrenching debate over the constitutional right to bear arms and Americans’ concerns over personal safety in a country with more than 390 million privately owned guns.

The discussion has intensified as a result of two recent mass shootings that shattered communities in New York and Texas.

Different branch of government, different article of the Constitution; but does anybody remember when the Hearing Protection Act was torpedoed in the aftermath of the Vegas shooting? I’m not holding my breath with anything from these people, but it would be nice to be pleasantly surprised.

How does the school shooting in Texas where a long-gun was used have any bearing on law-abiding citizens being intentionally denied the right to protect themselves by permitted concealed carry?

New York doesn't want any law-abiding citizen carrying concealed (unless they are a leftist celebrity or politician, etc.) even if they jump through all the permit process hoops of background checks, endless paper chases and applications. To me, it's a matter of "may issue" versus "shall issue."

Agreed. And thanks to banning of guns on schools, the perp in Texas (along with other school shooters) had a target rich environment.

The same month that Colorado's legislature was debating the potential passing of shall-issue concealed carry, Columbine happened, and it was torpedoed.

I'm convinced that the Roe V Wade leak was part of an attempt to make the SCOTUS look irrational and extremist. Then all these shootings happening around the same time?
I believe it's all because of the upcoming ruling.

Yep. I'll add that liberals are apt to try "but but but CONCEALED!" The issue is one of carry, open or concelaled, some sort of carry outside of the home is a constitutional right.

Leftists only want their leftist government personnel to have weapons. You got a violence problem? Let the police 'protect' you even if they don't do anything when they show up, OR they've been decimated (defunding) by even more rabid leftists who want no police at all (BLM, Antifa).

Why open or concealed carry matters:

When seconds count, the police are minutes away.

I carry a gun because I can't carry a cop.

"To Protect and Serve" is just a slogan on a squad car. The USSC ruled that LE is not responsible for "protecting anyone." They are there to enforce the law, even when that is long after the crime has already been committed.

Not long ago I applied (for the first time) for a concealed carry permit in Massachusetts. As you probably know this state is about as Maoist as you'll find in this country. Here,the city/town's police chief has *absolute* power to grant,or deny,an application.If you're denied your only option is to appeal to the State Police...an entity that just recently proudly announced that they will not,under any circumstances,cooperate with ICE's efforts to deny "undocumented workers" their "rights".

Fortunately my middle class town isn't quite as Maoist as Boston,Cambridge or Brookline (the town where Mike Dukakis got his start in politics) so after having been interviewed,photographed,fingerprinted and water boarded I got the permit.

However,my lawyer told me to be very,very careful because there are a million gun laws in this state,most of which make no sense,that they can,and will,use to put me in prison if I make one wrong move.

Correct. What they are doing is a partial restoration of Second Amendment rights.

I’ve found it very different even here in Georgia in different counties. Every county will issue permits but some take upwards of 2 or more months.

I used to live in Cobb County and their process for application and approval was lengthy and overly cumbersome. Here where I live now it’s been a matter of 15 minutes (my first permit) up to 7 days (now because they mail the card to you).

The last two times I renewed here in my county it was just a matter of going to the probate court and paying a $35 renewal fee and a new picture for the ID. Got it in the mail in 7 days.

Yes,of course there could be consequences...serious consequences...if you're forced to use your firearm.But my lawyer was referring to more mundane issues...like storage,for example.He said that most of the DA's in this state....Soros DA's....love to prosecute those accused of violating such laws.

I.personally,don't understand why SCOTUS doesn't use some case that comes before it to issue a detailed,comprehensive,explanation that "keep and bear" and "shall not be infringed" mean *exactly* that.

Yup....when I got the permit I knew a little bit about those laws,which are frequently found in Maoist states like Massachusetts,Neuevo York and Kalifornia,so I told my lawyer I wanted to talk to him about them. His practice was mainly real estate transactions and wills so he had to do some research before he saw me.

Among the many things he warned me about were storage,transportation and "brandishing".

Just FYI...if you're curious and have some free time check out this SCOTUS decision from a few years ago Caetano v Massachusetts in which they,in a 9-0 vote,overturned a Massachusetts law which they said severely violated 2nd Amendment rights. This law had been passed by the state legislature and upheld by every state court,including the state's Supreme Court.

In the decision SCOTUS called the state's argument upholding the law as "frivolous".

That will give you an idea of what happening in at least *some* states.
