West Virginia Sen. Joe Manchin said he'll 'wait and see' what Democrats say in their weekly lunches Tuesday before deciding how he'll vote on the Senate abortion bill.
Manchin - a moderate Democrat and key swing vote - made the comments Monday to NBC News, as a floor vote on the legislation is expected Wednesday.
With Manchin on the fence, it's unclear if the Democrats will even get all 50 senators in their own caucus to vote for the Women's Health Protection Act - far short of the 60 needed from members of both parties to override a Republican filibuster threat.
Earlier Monday, Senate Majority Leader Chuck Schumer and Senate Minority Leader Mitch McConnell took to the Senate floor to square off on abortion.
'I've clearly stated I will never support smashing the legislative filibuster on this issue or any other,' McConnell said. 'Yet Democrats want to wreck our institutions over their fringe position that Americans do not share.'
Some Democratic activists have advocated that Senate Democrats do away with the filibuster to codify Roe v. Wade before the Supreme Court potentially overturns it in June.
Manchin, along with Democratic Sen. Kyrsten Sinema, don't support that effort.
Schumer filed cloture Monday on the Women's Health Protection Act, which 'prohibits governmental restrictions on the provision of, and access to, abortion services,' the text of the bill says.
Manchin voted down a similar bill earlier this year.

That makes a lot of assumptions... there are a LOT of Assistant Democrats amongst the pubbies that will vote with the Rats on this.
How he votes might depend on if he is the deciding vote, like with Kavanaugh...
Joe Manchin wanted to be POTUS, he knows he probably won’t be so he’s squeezing every little bit of juice he can from the present situation.
OR
Manchin is acting the Sane Centrist in hopes of being the 2024 Dem nominee. Biden probably won’t make it to next year, but he could surprise me, and the grinning hyena VP doesn’t stand a chance in 24. With no stand out on the bench Manchin might be able to pull it off.
This is silly. Even if they pass it the states will fight it.

That's what I don't understand. If Row is overturned how would any other federal legislation not be mute. Its not a fed issue.
They can pass what they want and can manage to pass. But it seems to me that it would still be liable to judicial review, and there would be all sorts of challenges (???)

Senator, your state is West Virginia . . . NOT California or Connecticut.
Manchin is about the most popular US Senator in the congress. And he is in a red state.
He needs the Dems like a hole in the head. He will continue to vote for West Virginia interests.
How does that equal 60 votes?
Abortion is NOT in the constitution. Can you get that into your head?

That the Senate is taking this up is an admission that the SCOTUS opinion was not essential. It is an admission that the Senate had been passing the buck to SCOTUS for a hot-button issue. Consider all the rhetoric about “super precedent” during confirmation hearings.
