Senate Minority Leader Mitch McConnell says a federal abortion ban is 'possible' if the Supreme Court rules to overturn Roe v. Wade.
'If the leaked opinion became the final opinion, legislative bodies - not only at the state level but at the federal level - certainly could legislate in that area,' McConnell, of Kentucky, told USA Today on Thursday.
'And if this were the final decision, that was the point that it should be resolved one way or another in the legislative process. So yeah, it's possible.'
However, McConnell remained cautious when addressing whether Republicans would pass abortion banning legislation if they were to win back the Senate in the upcoming midterm election.
Democrats have been calling on President Joe Biden to try and enact such a law ahead of the November elections, which pundits predict will see his party face a wipeout at the hands of the GOP.
'With regard to the abortion issue, I think it's pretty clear where Senate Republicans stand,' he added. 'And if and when the court makes a final decision, I expect everybody will be more definitive. But I don't think it's much secret where Senate Republicans stand on that issue.'
McConnell's remarks come in response to a Supreme Court draft opinion written by Justice Samuel Alito that revealed that the court has voted to strike down the landmark 1973 ruling Rove v. Wade, which legalized abortion in the United States.
The draft opinion, which was published by POLITICO on Monday, comes amid nearly 50 years of federal abortion protections and could change before the ruling is finalized in coming weeks.

People need to read beyond the headlines. He specifically said that he wouldn’t support nuking the filibuster for such a ban, which means that it isn’t possible in reality even if it were possible in theory.
Except that’s not what the draft opinion says. It just says that abortion isn’t a constitutional right. Until Wickard v. Filburn is overturned then the federal
Government will continue to be able to legislate in areas that should be outside the scope of its powers.

The power of Wikcard v Filburn requires application by the Commerce Clause, not the 14th Amenmdment, must have an “interstate commerce” applicability, and was given more limited definition by United States vs Lopqez (1995) and United States versus Morrison (2000).

Even the great Scalia did not believe that. As Catholic as he was he did not think the Constitution had a mandate pro or con on abortion. Though he was a harsh critic of Roe, BECAUSE HE FOUND THE CONSTITUTION WAS MUTE ON ABORTION, I know he angered many pro-life Conservatives when he said that.
Using judges to use judicial fiat is the wrong way to create rights not enumerated in the Constitution.

Raich is the more applicable precedent and it didn’t limit Filburn enough. Filburn needs to be explicitly overruled.

It is not about my own pro-life position or yours. Its what the Constitution does and does NOT say.
If pro-abprtion folks want abortion madated as must be legal everywhere they are going to need a Constitutional amdendment to do it. And any federal universal ban on abortion is likewise going to a need a Constiutional amendment. Once Roe is revoked that is where the Constitution will stand.

Vasectomy is far and away the least expensive and most effective form of birth control, and it means that even unwanted sex, like rape and incest, isn’t going to force a woman or girl into a situation in which the crime is compounded by an unwanted pregnancy. And it’s reversible.
