Mitch McConnell says federal abortion ban is 'possible' if Roe v Wade is overturned - sparking Democrats to urge Biden to push legislation protecting woman's right to choose

Senate Minority Leader Mitch McConnell says a federal abortion ban is 'possible' if the Supreme Court rules to overturn Roe v. Wade.

'If the leaked opinion became the final opinion, legislative bodies - not only at the state level but at the federal level - certainly could legislate in that area,' McConnell, of Kentucky, told USA Today on Thursday.

'And if this were the final decision, that was the point that it should be resolved one way or another in the legislative process. So yeah, it's possible.'

However, McConnell remained cautious when addressing whether Republicans would pass abortion banning legislation if they were to win back the Senate in the upcoming midterm election.

Democrats have been calling on President Joe Biden to try and enact such a law ahead of the November elections, which pundits predict will see his party face a wipeout at the hands of the GOP.

'With regard to the abortion issue, I think it's pretty clear where Senate Republicans stand,' he added. 'And if and when the court makes a final decision, I expect everybody will be more definitive. But I don't think it's much secret where Senate Republicans stand on that issue.'

McConnell's remarks come in response to a Supreme Court draft opinion written by Justice Samuel Alito that revealed that the court has voted to strike down the landmark 1973 ruling Rove v. Wade, which legalized abortion in the United States.

The draft opinion, which was published by POLITICO on Monday, comes amid nearly 50 years of federal abortion protections and could change before the ruling is finalized in coming weeks.

People need to read beyond the headlines. He specifically said that he wouldn’t support nuking the filibuster for such a ban, which means that it isn’t possible in reality even if it were possible in theory.

Except that’s not what the draft opinion says. It just says that abortion isn’t a constitutional right. Until Wickard v. Filburn is overturned then the federal
Government will continue to be able to legislate in areas that should be outside the scope of its powers.

Mitch McConnell is wrong since the federal government has no say regulating abortion one way or the other. It belongs to the states!

Maybe men should keep their penises to themselves? Sometimes I think I am the only woman on this site.

The power of Wikcard v Filburn requires application by the Commerce Clause, not the 14th Amenmdment, must have an “interstate commerce” applicability, and was given more limited definition by United States vs Lopqez (1995) and United States versus Morrison (2000).

“McConnel is wrong”

You might want to think not about “abortion” but life. The right to life IS in the constitution and the federal government has the right to protect it.

“You might want to think not about “abortion” but life. The right to life IS in the constitution and the federal government has the right to protect it.”

Even the great Scalia did not believe that. As Catholic as he was he did not think the Constitution had a mandate pro or con on abortion. Though he was a harsh critic of Roe, BECAUSE HE FOUND THE CONSTITUTION WAS MUTE ON ABORTION, I know he angered many pro-life Conservatives when he said that.

Using judges to use judicial fiat is the wrong way to create rights not enumerated in the Constitution.

You keep referring only to abortion as though you have OCD.

Are you claiming there is no right to life, that a law can be passed to kill us all??

Raich is the more applicable precedent and it didn’t limit Filburn enough. Filburn needs to be explicitly overruled.

“The first batch was supposedly sent to my home, then supposedly sent to my bank. But it never did arrive. I even got on the IRS website and filled out a form to ensure it would come to me correctly. And after 12/31 the law was defunct and the IRS was not allowed to send it. I guess I should have been dead to receive it.”\

It is not about my own pro-life position or yours. Its what the Constitution does and does NOT say.

If pro-abprtion folks want abortion madated as must be legal everywhere they are going to need a Constitutional amdendment to do it. And any federal universal ban on abortion is likewise going to a need a Constiutional amendment. Once Roe is revoked that is where the Constitution will stand.

Thank goodness. I was worried Mitch might pass on the opportunity to say something stupid and unhelpful. Don’t you get it, moron? This is a state issue and a profoundly correct federalist decision. Though the murders will continue unabated in places like my home (for now) in CA, it is not for the federal government to be involved, one way or the other, unless and until you amend the Constitution, and that’s not going to happen

Mitch McConnell is stimulating the Democraps into taking more serious actions. He is showing his true colors. No wonder he spent 80% of his time sabotaging Donald Trump, while having a good laugh in the Senate cloakrooms with his Senator buddies. Most likely while downing Kentucky bourbon.

All to the same effect. One thing results in the other.

No excuse for unwanted pregnancy in this day. There are just too many preventative options.

McConnell is a complete and total idiot and apparently knows as little or less about the Costitution than the Democrats do.

Vasectomy is far and away the least expensive and most effective form of birth control, and it means that even unwanted sex, like rape and incest, isn’t going to force a woman or girl into a situation in which the crime is compounded by an unwanted pregnancy. And it’s reversible.
