California's pro-discrimination diversity mandate is unsurprisingly found unconstitutional

California thought discrimination in hiring was necessary for “diversity.” Unsurprisingly, the state’s law requiring such discrimination was deemed unconstitutional.

California Democrats have been on the mandatory diversity kick for some time now. In 2020, the state passed a law requiring publicly traded companies headquartered in California to have one board member from a state-approved list of minorities, with some boards being required to have two or three.

Using discrimination to create diversity has become the Democratic Party's new catechism — even President Joe Biden used quotas to fill his presidential Cabinet and judicial nominations. But mandating discrimination on behalf of racial minorities or gay and transgender people is not legal, so a California judge ruled it violated the state constitution’s equal protection clause.

This is not California’s only pro-discrimination law on the books, either. The state has a similar law mandating companies have at least one woman on their boards. That law is also facing a lawsuit, and it too should be headed to the legal graveyard for violating the equal protection clause.

White “Non Hispanic” males are a distinct minority in California.

Vastly outnumbered now, especially in Los Angeles.

Any White board is, in fact, a minority board.

Doesn’t matter. Local governments and private corporations will continue to enforce “diversity, equity, and inclusion” even without state mandates.

We narrowly passed Prop 209 in 1996, banning racial quotas in California state universities. But that was an exception. Most crazy California laws end up being struck down by the courts, such as the one that made it punishable by up to a year in jail to "misgender" a transgender nursing home patient. You cannot make this stuff up.

Her vote doesn’t change anything. There are at least 5 votes to kill Affirmative Action, and very likely six since even Roberts has been against it for a long time.

Her vote doesn’t change anything. There are at least 5 votes to kill Affirmative Action, and very likely six since even Roberts has been against it for a long time.

I wouldn't count on that. We have MANY traitors in our midst.

Last November, Prop 16 was to Repeal 1996’s Proposition 209, which banned the government and public institutions (like schools) from discriminating or giving preferential treatment based on sex, race, ethnicity or nationality. Prop 209 effectively bans public employers, universities and the like from using affirmative action, as it was seen as discriminatory.

PROP 16 FAILED

California Voters got it right, discrimination violates the California Constitution.
