Case CLOSED: Attorney Harmeet K Dhillon looks at KBJ's refusal to define a woman from a LEGAL perspective in d*mning thread

Beyond the fact that Ketanji Brown Jackson was obviously trying to keep from making the ‘woke’ masses angry by defining a woman, the fact she would go in that direction while being ‘interviewed’ by the Senate tells us she doesn’t really care about the law, she cares about the politics.

And as Harmeet K. Dhillon points out, this is not just embarrassingly biased but could have some actual legal ramifications.

Take a gander:

How do you adjudicate Title VII claims without being able to to answer this question? Title IX? https://t.co/VicNi0Yrjj

— Harmeet K. Dhillon (@pnjaban) March 23, 2022

Right? If you can’t define what a woman is how can you possibly make judgments based on, around, or even for women? What a huge misstep for KBJ, and what a sad world we live in that she felt this was the only way out when asked a question that could be politically damaging. We get it, if she had said, ‘a woman is an adult female’, the 10% of the country who thinks that’s somehow bigoted would have thrown a fit. Sadly, they are the loudest in the room …

But she’d be a SCOTUS justice for LIFE.

Why not answer the question?

I mean, as we now know, biology has nothing to do with being a "woman," so even from a Marxist/nihilist perspective, this is the wrong answer.

— Harmeet K. Dhillon (@pnjaban) March 23, 2022

Scary that we have to look at anything from a Marxist perspective.

3/ Sadly, Republican senators are more afraid of being called names by elderly white bigots (Sheldon Whiteclub, anyone?) than of putting someone on the high court who mocks them with such answers, ignores the law as written, falsely denies CRT influencing her judging… smh.

— Harmeet K. Dhillon (@pnjaban) March 23, 2022

Awww yes, Sheldon Whitehouse, the old white guy who belongs to more than one all-white club.

4/Judge Jackson is obviously academically qualified to be on the court, but that's a box-checking exercise. Today's answers demonstrate a calculating willingness to say whatever she thinks will get her votes or keep her from losing votes. Who is this person really? She won't say.

— Harmeet K. Dhillon (@pnjaban) March 23, 2022

Who is this person really?

She won’t say.

And that’s terrifying.

Judge Jackson sat in judgment of thousands of people in court. In each of these cases, judges are required to make credibility determinations. If a witness answered a question in this flippant/fake way, they’d be risking an admonition or even warning of contempt of court/ https://t.co/rLvYpmLIkX

— Harmeet K. Dhillon (@pnjaban) March 23, 2022

Oh you can bet your sweet arse if a witness had answered a question like she did as a judge she would not have approved.

2/Defense counsel: “Security guard, at the time did you say it was a man, or a woman, driving the getaway car?” Witness: “I’m not a biologist. 🤷🏽‍♀️” Would that answer fly in District Judge Jackson’s courtroom? It would not. And the witness would have no credibility. Case closed.

— Harmeet K. Dhillon (@pnjaban) March 23, 2022

Case closed indeed.

Because saying that would.offend the sensibilities of the liberals who push all this transgender stuff. We aren’t allowed to talk.about chromosomes and genitals or any physical characteristics. Thus, a liberal Supreme Court justice is flummoxed at being asked to define what a woman is. Her liberalism overrides any other thought process on the subject.

On Tuesday, on his show “Don Lemon Tonight,” CNN anchor Don Lemon said that the U.S. Senators who were questioning Supreme Court nominee Judge Ketanji Brown Jackson during the second day of her confirmation hearings had “no idea about the law.”

Lemon said, “We are watching what’s happening in Washington D.C. and just listening in the last moments, in my ear, here in Ukraine and Senator Marsha Blackburn was asking the potential jurist about the definition of a woman and talking about Critical Race Theory, it has become the new buzz term, right, like Acorn did or Antifa and on and on and on. It’s really amazing to watch someone who is, quite frankly, an intellectual giant be questioned by people who have really no idea about the law and what judges actually do, Laura.”

Anchor Laura Coates said, “It reminds me, and I can’t remember who said it but a paraphrase of ‘to my equals I debate, to all others I teach.’ I think she is teaching a number of people today in her conversations but also, interesting as you mention the point, what you’re really seeing here is the conflation of so many different issues that are in the national and political zeitgeist.”

Total insanity.

She didn’t sound dumb

I think it's dumb to play these games with her answers.

Regarding Judge Jackson's political side-stepping of defining a woman, have any of the post-17th Amendment, election year Republican Senators mentioned that the Supreme Court established precedent (imo) for recognizing male and female sexes when it decided Minor v. Happersett case against Virginia Minor concerning women's suffrage.

Note that Minor's efforts ultimately led to the ratification of the 19th Amendment.

"19th Amendment:
The right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of sex.

Congress shall have power to enforce this article by appropriate legislation."

I predict that Joe Manchin will preserve his seat in West Virginia by voting no but Mitt Romney will vote yes.

If you give birth to a human child from within your womb, you are a woman.

If you have a vagina at birth, you are a woman.

If you become pregnant through sexual intercourse, you are a woman. The same if you give your egg for in vitro insemination.

Calling a man “mother” doesn’t make him a female or a biological mother.

But then again, there are leftist Democrats whose whole personna is questionable, including their sanity, but that is for another comment.

That is why McCain was the perfect candidate for that faux election.
His family history of Admirals and his own war story make him the perfect foil to distract from Obama’s ineligibility.
It got everybody arguing about McCain and ignoring Obama.
Obama voted for the Senate resolution declaring McCain the be NBC because of his TWO citizen parents, even though he was born in Panama.
(the resolution did not make him NBC, as he was born in Panama, the country, not the Canal Zone)

become the new buzz term, right, like Acorn did or Antifa and on and on and on.
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
ACORN broke up into thousands of pieces, but did not go away.
Some of those pieces are Antifa and BLM.
Follow up questions:
Q: Ms. Jackson, President Biden stated that he would nominate a black woman to SCOTUS. If you cannot define what a woman is, how do we know that you fully meet the two established criteria he established for this nomination?
Yep, the 19th Amendment says sex, NOT gender. How long before trans activists demand it be reworded?
“...KBJ’s refusal to define a woman from a LEGAL perspective ...”
The word for this is, ‘compromised’.
No ‘compromised’ person needs to walk into a spot on the SCOTUS.
Judgment (by definition) requires impartiality and objectivity...you can’t undertake that kind of a job if you are already ‘bought and paid for’!
I think she actually answered the question:
According to Jackson, the definition of a women comes from biology. Because....SCIENCE!
This also sets aside all chromosome deniers like Bruce Jenner who is TransJennered.
This person scares the heck out of me.
I am a woman. My DNA is not a ‘social construct’, it’s a fact of Nature proved by science.
How can I trust someone to rule on issues affecting women, if she doesn’t even know what a woman is?
Another poster was correct - when she couldn’t answer, she should have been asked, ‘Are YOU a woman?’
