Father’s alleged threats against his son’s Morrisville basketball team results in felony terrorist charge

BOLIVAR, Mo. (KY3) - A 35-year-old Willard man is facing a felony terrorism charge after being accused of threatening one of the coaches on his son’s basketball team.

The incident happened during a high school tournament at Bolivar High School on January 27 in a match-up between a pair of junior varsity teams, Morrisville (Marion C. Early) and Branson.

Bolivar police were called to the gym around 7:40 p.m. on a disturbance call after 35-year-old Bryan Scott Pellham allegedly got upset with one of the coaches for the Morrisville team that his son plays on.

“From our interview, he was upset that a varsity coach was coaching the junior varsity team,” said Lt. Roger Barron, the Bolivar Police investigating officer. “He made the comment after engaging in an argument with the coach that he threatened to kill him. It was something to the effect of ‘I’ll put a red dot on your head and watch the mist appear.’”

Beat me to it. I think some BLM guy made similar threats against police a few days ago, and I don't think he's been charged with anything at all, much less "terrorism."

This still doesn’t sound pure classic “terror”. It sounds like mass-casualty (attempted mass murder) at best. Terror must include a philosophical element perpetrated by a group.

Exactly! How many actual.y violent blm a d a Tifa have been charged with terrorism? The answer is likely none, a d thise pukes actually followed through with their threats of violence- they weren’t just caught up in the heat of the moment screaming at someone like this father was, but rather blm and a tifa said what they meant and meant what they said, and they attacked en mass, all across this nation,, yet the left refuse to label them as terrorists

The left are bastardizing the term terrorism. They are changing the meaning to include everything now, even going so far as to call a peaceful trucker protest terrorism. They have found that it is a powerful word that allows them to do whatever they want In The name of “national safety”, and once they label someone a terrorist, or accuse them of terrorism, they thunk it gives them the right to destroy said people, ruin their careers, throw them In Prison without bail.

Jan 6 was the start of this bastardization of the words terrorism and insurgency, and now the bastardization of the word is accellorating at an alarming rate. This is how the left are wresting power away from the people, by galsey accusing them of felonies and domestic terrorism

Make a threat that the victim thinks is real.
Make the victim feel afraid.
And a few more factors.

Nothing about being a terrorist.

I have seen some really poor coaches. I saw one really berating group of 9-10 year old’s for losing a baseball game. I always figured the best way was to approach the coach a day or two later after they have settled down. If it happens again you have to make a decision on whether to let your kid play, take them out, or go up the chain. It is a good teaching moment for the kid as you can point out in life he his going to run into bad people and bosses and he will have to decide what to do.

That said, in this case one sentence said in the heat of the moment, being a terrorist treat, is clearly over reach. The schools are beginning to over react.

Usually you would be right as we had plenty of issues. But this was Poor WT from the sticks, Goshen Ohio.

We also played Goshen in Pee Wee football. Came back to my car after a game there and someone had poured their chewing tobacco juice all over the trunk lid.

I had made the mistake of driving the “good” car with a school sticker on the back.

Although I found a lawyer’s page labeling it “Terror Threats,” California Penal Code Section 422 is not about terror threats, nor is it named such. It’s merely “criminal threats,” and as such, prosecuting this hothead under it isn’t unreasonable. However, by merely apologizing and informing the victim that he was merely being a hothead, he would seem to be innocent of this charge, which requires the victim live under the sustained, realistic fear of harm, and that the defendant intended this outcome.

TITLE 11.5. CRIMINAL THREATS [422 - 422.4] ( Heading of Title 11.5 amended by Stats. 2000, Ch. 1001, Sec. 4. )
422.
(a) Any person who willfully threatens to commit a crime which will result in death or great bodily injury to another person, with the specific intent that the statement, made verbally, in writing, or by means of an electronic communication device, is to be taken as a threat, even if there is no intent of actually carrying it out, which, on its face and under the circumstances in which it is made, is so unequivocal, unconditional, immediate, and specific as to convey to the person threatened, a gravity of purpose and an immediate prospect of execution of the threat, and thereby causes that person reasonably to be in sustained fear for his or her own safety or for his or her immediate family’s safety, shall be punished by imprisonment in the county jail not to exceed one year, or by imprisonment in the state prison.

Official Legal commentary:

To win a trial on a charge of Penal Code 422, the prosecution must prove to the jury that:

(1) The defendant willfully made a statement that threatened to kill or inflict great bodily injury on another person;
(2) That the defendant communicated the threat through oral, written, or electronic means.
(3) The defendant had the intent that the message be understood as a threat and that it was intended to be directed towards the victim witness.
(4) It was a clear, immediate, unconditional threat which was specifically communicated the victim giving them the impression the threat would be acted on.
(5) The victim was actually in fear for his/her safety or that of his/her family, and the fear was continuous.
(6) The fear experienced by the victim was reasonable in light of the situation.
