House passes 'Protect Our Democracy' Act to curb presidential abuses of power

The House voted 220-208 on Thursday to pass the Protect Our Democracy Act, which addresses presidential abuses of power and reinforces the checks and balances between the branches of government.

One Republican, Rep. Adam Kinzinger of Illinois, voted with all the Democrats for the bill.

The bill now faces an uncertain future in the Senate, where 60 votes are required for passage.

The bill, which has support from the White House, aims to strengthen guardrails that were tested by former President Donald Trump, including limitation on presidential pardons, the requirement for candidates for president and vice president to submit their personal tax returns for 10 years, and the acceptance of any foreign or domestic emoluments.

Democratic Rep. Adam Schiff of California, the bill's sponsor, said the legislation, originally introduced in September 2020 and reintroduced this past September, echoes changes that were made following the Nixon presidency.

"Just as after Watergate Congress worked to enact reforms, so we must now examine the cracks in the Democratic foundation and address them," he said.

House Speaker Nancy Pelosi said at a news conference after the bill passed that it "ensures the strength and survival of a democracy of, by and for the people, defending the rule of law, revitalizing our system of checks and balances and restoring our democratic institutions."

"This legislation ensures that no one, not even a president, no matter who he or she may be, is above the law," Pelosi said.

Um......it's not for the Legislative Branch to determine what the Executive Branch can or cannot do.

That is left to the hands of the voters.

Protecting Our Democracy Act

This bill addresses issues involving (1) abuses of presidential power; (2) checks and balances, accountability, and transparency; and (3) foreign interference in elections.

Specifically, regarding abuses of presidential power, the bill

requires the Department of Justice (DOJ) and the President to submit to Congress specified materials relating to certain pardons;
prohibits self-pardons by the President;
suspends the statute of limitations for any federal offense committed by a sitting President or Vice President;
prohibits the acceptance of foreign or domestic emoluments, authorizes civil actions by Congress concerning foreign emoluments, and requires the President to make certain disclosures; and
sets forth provisions regarding enforcement authority of the Office of Government Ethics and Office of Special Counsel jurisdiction.
To address checks and balances, accountability, and transparency, the bill, among other things

authorizes specified actions to enforce congressional subpoenas,
requires appropriations to be made available for obligation in a timely manner,
imposes limits on presidential declarations of emergencies,
requires DOJ to maintain a log of communications between it and the White House regarding certain investigations,
requires cause for removal of inspectors general,
increases whistleblower protections,
reauthorizes the Merit Systems Protection Board, and
establishes penalties for political appointees who engage in prohibited political activities.
To protect against foreign interference in elections, the bill

requires federal campaign reporting of foreign contacts,
requires federal campaigns to establish a foreign contacts compliance policy, and
specifies that foreign donations to political campaigns and candidates of nonpublic information relating to a candidate are prohibited.

Frankly, most of this list looks like good stuff. You would think the Democrats would think about what giving this to the Republicans in 2022 would mean.. to the Biden administration, Obama and Fauci. No statute of limitations. Whew.. that’s gonna suck for some creeps.

They have been so busy accusing us of their own crimes that they believe it enough to think they won’t have to pay the price when reality comes knocking.

Clean up anything that is truly loathsome and pass it. Hard to imagine how Biden has the balls to sign it.

The United States is not and never has been, a Democracy. It is a Constitutional Republic and that is a significant difference that the Left does not want the citizens to know.
