I’m not sure it’s so clear-cut. The “victim” advanced on him twice while talking about taking the gun away from him, he and might have been coming at him again. He’s out of the frame when the shot is fired.
I agree with you as I stated on another thread the ‘victim’ was and out of control bully who was told a number of times. When the property owner retrieve hos weapon and and again confronts the trespasser he tried to take the gun away once he did that he was a threat and was treated as one.
There are two videos of this incident. In one you can clearly see the man firing twice into the chest of the other man.
I would convict of manslaughter. There was no need for any of that. He should have called the police and let them remove the man.

What is clear, is that the shooter had both time and opportunity to dial 911 when he left to get his firearm. We would have to ask him why he did not do that.
That said, it was the shooter’s private property. The angry ex-husband was asked to leave repeatedly, and did not, and made repeated advances while threatening and menacing the shooter and the woman.
Castle doctrine? Stand your ground? I would not vote to convict.

I’ve watched both videos. On one you cannot see the victim as he was shot. But on the other it is pretty clear the victim was standing still and not advancing when the stepdad backed up and shot him. The stepdad should have just gone in the house and called the police. Instead he escalated the argument by going and getting a gun, despite the evidence that the victim wasn’t threatening him or anyone else with physical harm.
