A Lubbock, Texas, man was shot and killed while arguing with his ex-wife over their child custody arrangement, and it was all caught on cell phone video.
The incident unfolded on Nov. 5, according to attorney Matthew L. Harris, who is representing the victim's widow. Harris says the footage was filmed by Jennifer Read.

Damn right! The smaller homeowner could have been killed or crippled by ONE BLOW from the dirt napping belligerent ex. He’s not obligated to take a beating on his own property to satisfy the sensibilities of weak-kneed pantywaist second-guessers. He’s not a cop, he’s a private citizen defending his own life and home. This is ALL on the dead guy....and his justice has already been served.
He was thrown back by the shootee. They are in Texas. Castle doctrine (shooter was on his property, advising shootee to leave immediately multiple times). IIRC, it was legal to get his gun under the doctrine, and brandish it. The fact that he fired the first shot into the ground may complicate things, but then again, I'm not a lawyer nor do I play one on TV.
Personally, I think shooter was an idiot for introducing the gun in the first place, but from what I've read, it seems it may have been legal to do so under Texas law. I personally would have called the cops and had them remove shootee for trespassing or something along those lines, but as far as introducing a firearm and then killing dude, might be a little over the top, even under Texas law.
Murder. There was absolutely no need to bring a gun into the argument, or to step back, aim and fire. He could have gone into the house and shut the door and gone about his day. Also, guys, don’t date single mothers if you can help it.
The shooter didn’t own the place, it was his girlfriends. He wasn’t the ‘homeowner’. I don’t know how much that complicates everything, especially when it was a agreed upon location and time to pick up his child.
That was brutal and no remorse by that guy and he should not even have been involved, it wasn’t his kid. Wonder how he feels now sitting in jail, or did he get bail.
Lol. I'm dating a single mother. Helped her through her court hearings for custody and such. Her ex flat out told the court he was terrified of me. Works for me. Judge gave her primary custody and awarded her child support. So far, I've been lucky, as the ex doesn't even like being in the same room with me, but we haven't had any major confrontations like this instance. Don't expect it, either. He can be terrified of me all he wants, as long as it keeps him away from my property.
I agree with you as I stated on another thread the ‘victim’ was and out of control bully who was told a number of times. When the property owner retrieve hos weapon and and again confronts the trespasser he tried to take the gun away once he did that he was a threat and was treated as one.

Offensive contact, a threat to take the gun and use it. He had the legal high ground, up ‘til then. I’ll be curious to see if he has a history of violence.

I wouldn’t charge the boyfriend, I would charge the wife for manslaughter for if she had not reneged on a legal order, the husband would not have been killed. I think a case could be made for it.

There are two videos of this incident. In one you can clearly see the man firing twice into the chest of the other man.
I would convict of manslaughter. There was no need for any of that. He should have called the police and let them remove the man.
This. It looked to me like he wasn't really trying to get that weapon away. It was more like a "get that thing out of my face." kind of move.
