Kyle Rittenhouse accuses Biden of ‘malice, defamation’

Kyle Rittenhouse slammed Joe Biden for “defaming” his character when the president tweeted out a video suggesting the teen is a white supremacist.

“It’s actual malice, defaming my character for him to say something like that,” Rittenhouse told Fox News’ Tucker Carlson during an hour-long interview that aired Monday night.

Rittenhouse, who was acquitted on all charges last Friday in his highly-publicized murder trial, was responding to a question from Carlson about how he felt over the president’s comments.

Biden, when he was a presidential candidate in September 2020, had tweeted that “there’s no other way to put it: the President of the United States refused to disavow white supremacists on the debate stage last night,” referring to then-president Donald Trump.

The post, which includes a 50-second clip, refers to a question Fox News host Chris Wallace asked Trump during a presidential debate about whether he was willing “to condemn white supremacists and militia groups” in the wake of unrest in Kenosha, Wisconsin, and other American cities.

Rittenhouse, in Monday night’s interview, also blasted Biden over his post-verdict prepared statement, where the president said he was “angry and concerned” over the trial’s outcome.

“Mr. President, if I could say one thing to you, I would urge you to go back and watch the trial and understand the facts before you make a statement,” Rittenhouse said.

I was listening to one of Kyle's early lawyers Robert Barnes, and he was explaining that Kyle's case for suing for defamation or liable is a much, much tougher situation than the Nick Sandmann case against CNN.

He explained that once you are indicted and tried for a crime, most liable case law has been that statements like 'murder' or 'white supremacist' are no more damaging to a reputation than the indictment for the charge, even if later found not guilty.

Barnes thinks Kyle could win some of the defamation cases, but couldn't really show damages and thus wouldn't win much compensation in court.

IMO Rittenhouse should now keep his mouth shut and let his lawyers do the talking...in Federal court...Civil Division...tens of millions of dollars.

Future Headline: CNN just got a tip that the FBI is raiding Kyles house and his lawyers houses in predawn SWAT action to uncover “systemic racism and possibly copies of Bidens’ daughters diary”...

How about the racebaiters now, who STILL continue on with this stuff? After the facts are out , Id assume people still defaming him have to liable for something.

Very polite, but also right to the point.

Barnes didn't say that they weren't liable, they are. The problem comes when you try to claim damages to your reputation, which are, and I forget exactly how he phrased it, were secondary to the fact that you were charged and tried, which was a much bigger "hit" on your reputation.

Here's a video of Viva Frei and Robert Barnes discussing the issue: https://youtu.be/Rf3ov5yYNb4?t=3177

Barnes thinks Kyle could win some of the defamation cases, but couldn't really show damages and thus wouldn't win much compensation in court.

So Rittenhouse would have to wait until he was denied employment or a scholarship, and then prove that the reason was Biden called him a "white supremacist?" Biden's lawyer could argue that SCOTUS has given wide latitude to opinions, but today some HR departments are likely to take such slurs quite seriously.

Sandmann won a settlement where the damages were projected loss of income.

I have no doubt that future employment courses are foreclosed due to the defamatory, false and misleading press coverage and resulting social divide. No employer wants a lightning rod, and the social divide is not going to resolve in Rittenhouse’s lifetime.

Just saying that the reason his emplyment options are limited aren’t necessarily because the employer believes the lie. I can be becuase the lie has created a controversy that can’t be resolved.

Yes, that is one thing that “ take such slurs quite seriously” could mean. On the other hand, I think that we will never be sure whether some people believed the Russia lies, or pretended to believe them because they were afraid to swim against the tide.
