'Rust' Insurance Policy Covers a Maximum $6 Million for Injury or Death

Halyna Hutchins' family is almost certainly gearing up for a wrongful death lawsuit -- in the wake of her death on the set of the movie "Rust" -- and TMZ has learned the insurance policy that covered the production is limited to $6 million.

We obtained the face sheet of the insurance policy written by Front Row Insurance Brokers. General liability coverage is limited to $1 million per occurrence.

typically there are numerous requirements insurance companies impose and violations of those requirements could allow the company to deny coverage. For instance, given this was a policy to cover a western with various gun scenes, there may be an exclusion if there was live ammo on the set.

I think everyone, especially the injured and families, deserve to know exactly why a trigger was pulled during REHEARSAL. And why the ballistic shields were not in use, nor the humans removed from the line of fire.

6M is the liability limit and the carrier will pay up to that amount, yes. Plus the carrier pays all legal fees in defense. In many states, if liability is clear and the value of the case is higher than the limits, the carrier may have to pay a judgment that exceeds the policy limit. This is a bad faith case, which are pretty rare. Nevertheless, carriers are very cognizant of potential bad faith claims.

This is all a conversation I never want to have with my insurance company.

Which, after all, is why I cover myself with liability insurance.

I guarantee Baldwin doesn’t get charged. People here, of all people, should understand that the Left has politicized every single thing in life.

Not really that low. There are jury instructions that tell the jury that the damage award should not be based on the eggregiousness of the negligence. Juries don’t always follow that in reality. Wrongful death cdamages are capped at the amount of the pecuniary loss - some wrongful death cases are actually worthless. This is a jury case in contrast to most. As far as the injured guy, I seriously doubt his injury will be permanent, except for some scarring. National media will make an indefensible case defensible.

How much $$ would the victims have realized over the remainders of theirs lives. Sounds like the AD wasn’t hurt too badly, and might be partially culpable. The Cinematographer though......I don’t think $6M will cover it.

A liability insurance carrier can disclaim coverage based upon the language of their policy. Insurance does not cover damages expected or intended from the standpoint of the insured - you get covered for an occurrence that is an accident. This exclusionary language is construed strictly against the insurance carrier. Additionally the carrier needs to carry the burden of proving facts that brings the damages within the language of their exclusion. The carrier generally does not disclaim unless they 100% right. There will be no disclaimer here I will guarantee.

I realize that. But then again it’s hard for me to feel much sympathy for Baldwin’s ‘plight’. I realize that was very likely a terrible accident, but he pointed a gun at a woman, pulled the trigger and killed her. His life shouldn’t ‘ever be the same again.’
