'Rust' Insurance Policy Covers a Maximum $6 Million for Injury or Death

Halyna Hutchins' family is almost certainly gearing up for a wrongful death lawsuit -- in the wake of her death on the set of the movie "Rust" -- and TMZ has learned the insurance policy that covered the production is limited to $6 million.

We obtained the face sheet of the insurance policy written by Front Row Insurance Brokers. General liability coverage is limited to $1 million per occurrence.

Even if the company covers, I would think that $6 million might not be enough compensation for wrongful death.

Incredibly low coverage for a business like that. They went on the cheap and were lax on safety and will pay a big price.

Specifically the life of Alec Baldwin - producer - will never be the same before and after this mess is settled.

The liability limits are misleading.

While the insurance is limited to 6 million, what it means in practice is that the insurance company will pay up to 6 million to defend the insured against any action.

What you want is for your lawyers to show up and get paid. That is what the insurance guarantees. More important that indemnifying a judgement.

Generally, wrongful death damages are the pecuniary losses suffered by dependants. There is no recovery for the suffering of the decedent, unless that is allowed by the statute. Each state is different. $6M is more than amply in most cases. The decedent here is a high income earner, so the case is pretty juicy.

This is liability coverage that covers negligence. The Accord Certificate TMZ published does not describe any self insured retention - where the insured pays the first dollars of the settlement or verdict and then insurance indemnity kicks in. So no deductible most likely

It’s not enough. For the dramatic MULTIPLE LEVELS of negligence, the injury to the director, PLUS the horrific wrongful death of the cinematographer, $6 mil is low.

It depends first on whether the prosecutor has a hard on for the negligent person. Santa Fe County went 76% Biden, so don’t hold your breath about charges being filed.
