Minor nitpick - Health Insurance Portability and Accountability Act of 1996 (HIPAA)
HIPAA not HIPPA
but to answer the title, First the rule has to be put in place (not currently in place) and THEN someone can file a lawsuit.

Or fire a girl who becomes pregnant.
Pregnancy is covered under FMLA and other laws.
