McDonalds PR campaign against Mrs Liebeck was, sadly, successful. Even FReepers believe the BS. Thanks for the post.

It used facts. You can go to the Find Law site as I stated. It has the same facts.

Who ever claimed McDonalds was supposed to brew coffee at a lower temperature? Liebeck sued McDonalds because they required their franchisees to hold and, thus, serve their coffee at 180-190 degrees.

I will admit that I’m addicted to their Chai Tea Latte. MMMMM.... good. With that said, I have always tasted it before leaving to ensure I wasn’t given the wrong item. On occasion, it has been so hot it about scalded the inside of my mouth. So, it does happen.

Do you actually think anyone will bother to read it?

The McDonald's Hot Coffee Case

Ask most non-attorneys about the McDonald's "hot coffee" lawsuit. Chances are, they've heard of it; but the true facts of the case remain a mystery to many people, particularly those who ridicule the plaintiff as someone who took advantage of the legal system for financial gain. But nothing could be further from the truth.

The McD suit was actually righteous.

LOL, memo to myself: coffee is Hot. NONE of these class action lawsuits are "righteous".

The kiosks are all over the place and there must be another six under construction in the Coeur d’Alene / Post Falls area.

How many are Dutch Bros?

Starbucks doesn't keep their coffee as hot as McDonalds did in the '80s, at least not as a matter of policy.

I looked up and read this lawsuit. The only part that I think may go anywhere is the claim that there was something wrong with the lid that caused it to pop off. Starbucks changed the material on their lids a few years ago, and they are harder to keep on. But that's still pretty weak.

First and second degree does not add up to “severe.”

Makes as much sense as severe paper cut injury ...

1st degree burns are not an assumed risk from a beverage.

They sue because they know there’s a pay off one way or another.

McD case had third degreee burns and five-or-six-figure medical treatment.

1st degree is redness

2nd degree is blisters

3rd degree is “burn the meat.”

I know.

I was just saying these types of lawsuits where someone is arguably voluntarily buying something because of a specific trait about it (like really hot coffee) — and that decision comes back to bite them in the butt — should be simply thrown out.

The world such lawsuits ultimately creates can be proverbially summed up by that one scene in Dirty Rotten Scoundrels where Steve Martin’s character is pretending to be an idiot and is eating with a fork that has a cork stuck to its tines,

We simply disagree. She ordered hot coffee, that it was hotter than a home coffee maker is immaterial. McDonald’s coffee was on par with industry standards. But in the end she spilled it on herself. This was like suing a sledgehammer maker because you dropped it on your toe.

Most adults will suffer third-degree burns if exposed to 150 degree water
for two seconds. Burns will also occur with a six-second exposure to 140
degree water or with a thirty second exposure to 130 degree water if the
temperature is 120 degrees, a five minute exposure result in third-degree
burns.

I get Nitro Cold Brew and a hot pumpkin spice latte. That nitro cold brew is a caffeine rush like you would not believe. Slam it like a cold beer on a hot day, then sip the latte for half an hour. It’s an expensive treat so I only do it a couple times a month.
