Judge G. Michael Harvey sounded floored.

During a detention hearing this week for Robert Morss, arrested last month for his involvement in the Capitol protest, a federal prosecutor told Harvey she needed permission from the government before she could turn over to him a slice of video related to Morss’ case. Joe Biden’s Justice Department continues to seek pre-trial detention for people who protested Biden’s election on January 6; prosecutors want to keep Morss, an Army ranger and high school history teacher with no criminal record, behind bars until his trial can begin next year.

But assistant U.S. Attorney Melissa Jackson hesitated when Judge Harvey asked to see the footage captured by the U.S. Capitol Police surveillance system cited as evidence in government charging documents.

“Why haven’t I seen the video?” Harvey asked Jackson on Wednesday afternoon. She told the judge he could have access to the body-worn camera recordings and public source videos but that the USCP footage is under a protective order, which is common in most January 6 cases.

After Morss’ defense attorney said the photographs in the charging documents did not accurately reflect the video evidence the government gave to her under discovery requirements, Harvey demanded to see it for himself. “And anything you show to me . . . I’ll issue a minute order to release it to the public as well.”

Jackson informed the court she would submit the missing video evidence on Friday.

The hearing is the latest example of how hard the USCP and Justice Department are fighting to keep more than 14,000 hours of surveillance video under wraps. Lawyers for the USCP insist the recordings can’t be released for fear doing so will give wannabe insurrectionists too much information about the inside of the complex;

The role of the USCP outside of the Federal Triangle has turned into quite a big deal, without anyone realizing it.

They are not part of the executive branch, and they do not derive their authority from an Article III court.

The 'complex' being the U.S. Capital. I was unaware this was a secret installation like the NSA or Area 51.

History repeats and this appears to be a form of a 'Star Court' as found in the reign of the Tudor Monarchs. Without our Constitutionally mandated separation of powers, Executive/Legislative/Judicial, the 'Court of Star Chamber' (full formal name) was an instrument of the monarch's privy court with his close officials acting as judges.

In these cases, as opposed to courts of 'common law', the judicial constraints / safeguards for the defendants are reduced or eliminated for the convenience of the monarch. To the King, it was for efficiency, to the subject, it was a threat!

In this panoply of 6 January cases, the Executive, Biden Administration, is withholding potentially exculpatory (innocence-refutation) facts from the defendants for the government's advantage. Rights of speedy trial and 'habeas corpus' become delayed as the defendants lack the information to dispute the prosecution's case. For precedent in Federal Prosecution of withholding exculpatory evidence, see Republican Senator Ted Stevens (Alaska)'s ugly case (2008) and others.

I could understand detention of those who began tearing stuff up on Jan.6th. I've watched many videos of that day and there were bad actors. Remains to be seen if these were infiltrators to the Trump/conservative cause.


I have seen the actions of those inciting the mob. Were all the videos to be released, it would not be hard for competent authorities to identify the instigators. The instigators must be identified!!!

Yep. This will not end well.

A sizable number of the populace has been given carte blanche to hate, disenfranchise, and even hurt Americans who they don't agree with, resent, or are envious of. Worse, most of the media, social media, and academia support this hatred.

Potentially. And a few new conservatives may be elected giving the GOP majorities in the House and Senate. However, if Mitch McConnell and Kevin McCarthy hold the leadership positions, thereby controlling the committee assignments and campaign funds for 2024, do you really anticipate the GOP will be any more effective in its opposition to Biden than it was against Obama from 2015-2017 when Mitch and Paul Ryan controlled Congress?

Electing a few more Republicans who profess to be conservatives does not mean conservative government or even adherence to conservative principles. At best the Republicans in Congress I’ve observed are pragmatists, not principled ideologues. At worst they are active collaborators.

I believe these persons are being detained by the US Capitol Police. I do not believe their detention is under the authority of the Executive Branch.

We have really missed the pitch on these cases. There are a couple of things we need to know like - yesterday, such as: Does the Congress (the detaining authority) consider itself bound by Amendments 4, 5 and 6? Does the Congress recognize its prisoners as having the right to a Habeus Corpus petition to an Article III court? Who or what is the ultimate authority who has the power to release these prisoners?

I’m sure there are many other constitutional issues I’ve missed

The $64,000 dollar question, though, is why isn’t this the biggest news story in the history of the Republic?
