Wis. woman alleges cheese, tomato sauce fraud in Bagel Bites Pizza Snacks lawsuit

A Juneau County woman filed a federal lawsuit Sunday against the company that creates Bagel Bites Pizza Snacks, alleging that the packaging of the product deceives customers because it does not have “real” mozzarella cheese and tomato sauce.

According to the lawsuit filed in federal court, Kaitlyn Huber argues that the packaging of Kraft Heinz Foods Company’s pizza bagel snacks is misleading. She alleges the front label’s emphasis on mozzarella cheese and “REAL” dairy is false because the product does not contain real mozzarella cheese.

She also argues that “reasonable Wisconsin consumers” would expect a product with tomato sauce to only contain tomato ingredients and seasonings, not thickeners.

The lawsuit also states the dairy industry is “more integral to Wisconsin than potatoes are to Idaho and oranges to Florida.” According to the Department of Agriculture, Trade and Consumer Protection, the dairy industry contributes $45.6 billion to Wisconsin’s economy each year. She notes that the state makes just over a quarter of the nation’s cheese.

Huber also alleges that the “REAL” dairy seal is misleading, comparing the one used on a Bagel Bites box and a “REAL” Dairy Seal.

The lawsuit was filed as a class-action lawsuit, meaning on behalf of anyone who bought the pizza bagels in the state. The lawsuit seeks an unspecified amount of monetary damages for consumers, as well as for the company to change its packaging.

NBC15 has reached out to Kraft Heinz Foods Company for comment and will update this story with their response.

I assume this women works for the dairy industry in some way. But she is not wrong. This is a crap product which is passed off as bite sized pizza that has all the same ingredients as regular pizza. The real is not real cheese, but rather there is real dairy somewhere in the product. I hope she wins. This crap does not need to be mislabeled on the store shelves. If they want to state that its kinda like pizza, with some dairy and some tomato but it tastes good. So be it. Kraft has long been in the business of making fake food. This is just their latest effort.

I sure wouldn’t expect cheap, frozen snack food to be free of thickeners.

Also, the boxes say contains real cheese, and from the various ingredients lists for the different varieties I’ve glanced at, it does appear like they contain cheese. The fact that the blends contain other things besides cheese doesn’t change that.

Yes, these companies do everything they can to make their products sound as healthy as possible while staying technically accurate. But every adult knows that it’s up to you to check the ingredient list and nutrition information to see if it’s what you want. These lawsuits are so pathetic.

Every adult doesn’t even do that since we know the ingredient list never states actual ingredients and that eating boxed crap is never healthy. If you are so lazy as to buy microwave products then simple deal with the results. I have never checked a pizza roll or frozen pretzel ingredient list. I know it will not say everything that’s in the box. I accept that. I have checked some products for sugar or fat content, knowing that those numbers, too, might be way off from reality.

Wrong. There is mozzarella cheese, sauce, and pepperoni in the product. There's also a lot of added crap, but since when is it a conservative position to support these kinds of health-nut lawsuits? And pizza purity should not be a reason to sue. Spare me. They are supposed to, but I agree that a lot of dodgy crap goes on and companies lie.

The main point is that no one expects pizza bagel bites to be authentic pizza or not contain thickeners or anything else like she claims. If you’re eating bagel bites, you know it’s crap that isn’t authentic in any sense of the word. Tasty crap, maybe, depending on your palate, but still crap.
