Old article on the constitutionality of lockdowns. Basically states can do whatever they want, although equal protection clauses could be used to strike down a law if, for example, one law was stricter on one type of business over another.

Federalism is one of the many great things about the US. When one state like New York or Michigan enacts stupid laws, their citizens can move from that state to one that has better laws, such as Florida and Texas.

This article discusses how deaths are BELOW normal levels now. Who are we saving with lockdowns and masks? How far below normal do they want the death rate to be? Again, the only explanation is that a life lost to Covid, even if they are and 88 year old diabetic, is worth more than the life of 20 year old suicide victim, a car crash fatality, and the lives of a family destroyed (or not started) due to lockdown impacts on the economy.

The 14th Amendment is relevant as is the Interstate Commerce clause.

An ordered lockdown is only applicable to the residents of the State locked-down.
Residents of other states do not have to comply when in the locked-down State.

Interstate Commerce is violated when a business, operating in multiple States, is treated differently among those States simply by having operations within a certain State.
Any such orders must be approved by Congress.

On the critical reading of the Constituion:

1. Know that the Constitution is written so that a well-educated citizen can “interpret” it for himself. It was not written as a exercise for lawyers to parse.

2. The Constitution holds pre-eminence over all other laws, rules and regulations. Do not look to the CFR for interpretation of Constitutional exertions of People’s rights.

3. The Constitution is a document intended for The People, not a person. It is a “nationalistic” statement of understanding.

Be comfortable in your application of what you read.

What is your view on incorporation? This is the legal view that that the US constitution applies to the states as well when they enact laws...this is a stumbling block for me.

Incorporation is an extra-Constitutional concept; the 14th should never have been enacted.
But it was.
We have live with it in the near term.
Incorporation is why we can have several separate firearms regulations in each State when the plain language of the Constitution forbids it.

I contend that we have been “duped” into believing all amendments to the constitution are codification of natural law rights.
they are not.
They are re-assertions of PRIVILEGES found in the Constitution.
EX: We did not have a \right\ to vote until the 25th Amendment called it such.
What the government gives, it can take away.
Our natural law rights are found ONLY in the Bill of Rights.

What is your view on the above link? Essentially they claim that a state can and should be allowed to be as tyrannical as they want to be as the constitution only applies to the federal government. This is also what I believe. But somehow the Supreme Court and the 14th amendment change this?

This is why I have thought that state governments can enact strict lockdowns and do whatever they want. THIS DOESNT MEAN I THINK THEY SHOULD. But it does mean I think they can.

The article is an opinion piece.
I assume it has an agenda.
I stopped reading after determining that the agenda was to sow confusion.

The Constitution begins with We the People.
Pretty straight forward that, the entire Constitution is for the order and preservation of the American society.
That was so valiantly fought for.

Here one must point out that wordsmithing has taken place in the past to distract from correct understandings.
You are ALWAYS a citizen of the USA and allowed to claim residency in a specific State. (Article 4).
Your residency may change but your citizenship doesn’t.

The 14th states: “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States.”
[note of emphasis...make or ENFORCE any laws]

If the Constitution only applies to the federal government then States Constitutions only apply to States’ governments.
And, any decrees by the governor only applies to the members and employees of the [specific] State government.
Works both ways.

The US Constitution \constrains\ the federal government from any liberty in establishing laws while allowing citizens their enumerated liberties.
The US Constitution is a codification of our FREEDOM (reference: the Declaration of Independence, “life, liberty and property” sic)
The First and foremost liberty is the liberty of their own/individual/conscience (1st Amendment).
The assumption here is that the individual conscience is constrained by human compassion (10 Commandments).
