You won’t find an example of ANY judge that opined in a way that anyone would agree with 100% of the time.

There are different types of conservative justices. Textualism is different than Originalism which is different than Libertarianism which is different than Populism.

Scalia voted with arch liberals Brennan and Marshall in Texas v. Johnson (burning the American flag is free speech) in the same case that William Rehnquist dissented.

Scalia and Rehnquist were two different types of Conservative jurists.

Thomas and Scalia voted with three liberals in Kyllo (using a FLIR on a home) while arch liberal John Paul Stevens dissented in that case.

Scalia and Thomas joined Kagan, Ginsburg and Sotomayor in Florida v. Jardines when it came to using a drug sniffing dog on a home.

Alito was in the dissent in that case.

Byron White is another example of a Justice that is almost impossible to classify. He dissented in Roe, wrote the majority opinion in Bowers, and he generally hated substantive due process. Yet he often voted liberal when it came to race.

Constitutional ideology is far too complex to break down into a perfect left/right bracket like the moron class on both sides likes to pretend.


No need for a long dissertation. The proof is in the pudding: SCOTUS signed off on the stolen election after supervising years of unconstitutional assaults on President Trump and his supporters. They are every bit as guilty as the Deep State criminals who thuggishly attacked many who dared support POTUS.

There two types of Justices these days: Patriots and traitorss. Only Thomas and Alito have consistently stood with the American people in these historic times. History will damn the rest.

Not to defend the drive-by poster, but here are some data:

Over the past two years, the (Kavanaugh-Roberts) bromance has budded. In OT 2018, Roberts and Kavanaugh were in full agreement 78% of the time, and agreed in full or part 89% of the time. In OT 2019, Roberts and Kavanaugh fully agreed 88% of the time, and agreed in full or part 92% of the time. For OT 2019, the runner-up doublet was Justice Breyer and Justice Kagan, who agreed 82% of the time. By contrast, Justices Thomas and Gorsuch agreed only 52% of the time. And Roberts and Thomas agreed only 41% of the time. So far this term, the trend continues. On Thursday, Roberts and Kavanaugh were wingmen with the Kagan-three in two sharply divided cases: Torres and Ford.

I found that odd too. Kavanaugh was clearly to Amy Coney Barrett's LEFT, but they went ballistic with Kavanaugh's nomination and blew their entire wad opposing him tooth and nail. Why they were so upset about an mundane establishment hack Anthony Kennedy clerk replacing Anthony Kennedy is beyond me. I expected the RAT opposition to her to be 20X worse and them to blanket the airwaves with ads 24/7 "warning" everyone that ACB is a "far right wing religious nutcase" who thinks the Virgin Mary tells her to ban abortion, or some character assassination theme along those lines. By the time they got done with her, I expected the public to see her as the looney mom in Carrie.

As it was, the ACB nomination was just the RATS bitching about it quietly and it sailing thru overnight.

The GOP hasn’t won the popular vote in near 30 years. Waves of migrating Democrats are slamming red states and turning them blue. Election integrity matters little when Democrats can legitimately win elections. That horse has already left the barn. Sorry.

Barrett was closer to the election and female. So the Dems backed off a little. They had the Chicom flu and Zuckerbergs billions backing them up. So they played it a bit safe, IMO.

I'm old and a cynic already.

But this information about Kavanaugh and Barrett being in bed with the democRATS already, after the democRATS dragged them through the confirmation hearing mud, is very disturbing and makes me even more cynical to the point of being fed up with the whole mess.

Our whole federal government appears to be dishonest, compromised and corrupt.

Indistinguishable from third world shit holes.

From the track record so far, the term "originalist" seems to be the judicial equivalent of a politician running as a "FISCAL conservative".

That is, anyone who is loudly touted as one, ISN'T one.

Nope, but I find it interesting how FReepers continually curse out Bush for “giving us Roberts”, but give Trump a pass when had THREE chances to give us a “Scalia-like judge” and we have yet to see ONE time he actually did so.

So much for the “God bless PDJT for KEEPING his campaign pledge to name pro-life originalists to SCOTUS”

But meh, it’s somehow all McConnell’s fault, right?

McConnell must have written that list of awesome “originalists” that Trump put out during the 2016 campaign, and the AlwaysTrumpers on FR were gloating about at the time. It had Gorsuch and Kavanaugh on the short list, and they had been “fully vetted” to ensure they were “proven originalists in the Scalia mold”

Shame on McConnell, tricking Trump into picking swamp creature Bush leaguer crappy judges from that list. He must have forced Trump to pick from only those judges!

If only Trump hadn’t listened to him and had been able to draw up his own “list”, instead. Then, we surely would have gotten the “best people” since that’s the only kind of people Trump appoints.

Man, its all McConell’s fault!

This is not complicated. Hyper technicalities are a strategy to divert.

There are six Justices nominated by Republicans on a nine person Court - yet Dems keep winning rulings.

How does that happen?
