The rough outline of his argument is this: The 22nd Amendment doesn’t say you can’t be president for more than two terms. It says you can’t be elected president twice. If a Biden-Obama ticket won (which we’ll get to), and tragedy were to befall Joe Biden, Barack Obama could become president, according to the letter of the law (which we’ll also get to), since he wasn’t elected to the position. As such, Obama is not constitutionally ineligible to serve as president.
Ergo, Harris could pick Barack Obama and have him confirmed through a House and Senate vote, which at this unique time with a 50-50 split Harris casts the deciding vote.

Actually, if they keep Biden in place while the confirmation takes place, Harris casts the tie break vote.
So let’s say they announce Biden is stepping down in 60 days. That gives them all the time they need to select and confirm Harris’ choice for VP.

I'll bite, why are you confused?
It may be wrong but it only sounds wrong then to a very few people...
Many think that the awkward version sounds smarter. The same goes with the use of "myself" in place of "I" or "me" in a sentence.
Example: David and myself went to the park.
I am not confused, but I was mistaken where the Presidential chain of progression was dictated by law. I thought it was the Constitution, but it was an act of Congress.
I knew it existed, and could not understand why people could not look it up themselves like I did in this digital age.
