Horowitz: Gov. Noem’s retreat on South Dakota transgender bill shows the need to make red states red again

Every statewide partisan officeholder in South Dakota is a Republican. The GOP controls the state House 62-8 and the Senate 32-3 — the largest majorities ever. Yet they can't seem to ban castration of minors or prevent men in female sports as part of the loony transgender agenda. What gives? They are plagued by the same business lobby preventing every other GOP supermajority state from protecting its historic cultural conservatism.

Disagree. Her “reasonable explanation” is that she’s afraid of retaliation from the NCAA and Amazon.com, so she’s caving. Yes, I know, “sending it back for revisions that will pass legal scrutiny.” Got it. If you believe that’s actually going to happen and she’s going to sign a revised bill in the near future, I’ve got a bridge to sell you. Don’t kid yourself. This is kick the can down the road and hope it doesn’t roll back.


That’s definitely what is going on here. Another FReeper reported the SD legislature is only in session for like 30 days in off years. They’ll never deliver a bill of substance on this issue after bullying and bribery from the Chamber of Commerce.

Noem is doing the bidding of gaystapo to cheers from the surrender caucus wing of the GOP base. What’s not to like from her perspective? She minimizes her risks in a bad situation and keeps corporate donors happy. The only losers here are the girls Noem pathetically claims to want to support.

Her snarky “Well Tucker, did you read the bill?” had a really petty tone to it and didn’t exactly bolster her credibility.


You took that as snarky? I didn’t hear challenge in her tone at all. It sounded more like she was trying to confirm at least that common ground, as she’d already had to stop and back up several times as they talked past each other.

You’re too kind - Tucker was out for BLOOD and wouldn’t stop talking over her and was likely pissing her off due to disrespect. I thought she held it in check pretty well considering she never vetoed the bill, will sign a revised bill cover K-12 and take on the NCAA separately with a coalition of states. She’s about 4 steps ahead of everyone trying to roast her.

Not much to discuss, the simple question is whether the NCAA should be SETTING POLICY in SD, or the voters (who strongly supported this measure). She chose the NCAA. Her base will remember this decision.


Actually, it looks like she is splitting the battles, where she can maintain separation within K-12 regardless of what the NCAA decides, and then deal with the NCAA trying to do what it wants to do as a separate matter.

The ACLU, woke Amazon and the LGBYTQ crowd agree. Ask yourself why you are standing with them on this issue.

I didn't read the bill or hear her explanation; so I'm not taking sides until I know more. But what I do know, is that many freepers post without reading the full article, and others don't reallly understand how carefully worded a bill must be in order to avoid unintended consequences—or failure of the stated purpose, making things worse.

What I would hate to see is that this promising conservative gets trashed before all the evidence is really in. Look how many people trashed Trump before giving him a chance. So I pointed out the difference between the bombastic condemnation of Noem and the posts of those who saw her explanation.

Exactly. Two vector attack.

Defend the K-thru-12 youngsters on South Dakota ground, a state matter, by improving the state’s legislation -— instead of the state matter being externally legislated from the bench of the US Supreme (and lower courts).

Defend women’s sports - the collegiate level problem, separately via broader, national support.

She wants them to rewrite the bill and remove collegiate and just include K-12. Then she wants to build a nationwide coalition to fight the NCAA. I think that’s a good idea. College students are adults and they choose the university they want to go to. Plus according to Noem, lawyers have told her she would lose a court case with the NCAA.

The other thing was the yearly proofs kids would have to agree to and schools would have to implement. Age. Every single year they have to prove their age? That’s just stupid. They’re a year older than last year, daah. Genetic proof of biological sex. Gotta take a DNA test every year? Biological reproduction. Not sure what the proof would be on that one. Drop your drawers and let us see your genitals?

Just write a simple law, no biological males in girl’s sports and let the kids sign an affidavit saying they are a biological female and upon signing this, you agree that the coach or school admins can kick you off the team if they think otherwise. To fight that decision, YOU must provide proof of your biological sex.

Easy peasy.

The kids are going to know who’s a male. The coach is going to know. Hell, we know right off the bat when we see pics of them.

Exactly - it’s a quick win for K-12 and a better plan to protect against NCAA litigation hopefully without losing benefits they bring the state which people care about.
