New Mexico Supreme Court upholds murder conviction in ‘warrior gene’ case

The state Supreme Court on Thursday upheld the murder conviction of a man whose public defender argued a “warrior gene” predisposed him to impulsive violence — making him incapable of forming the intent to kill his victim.

Anthony Blas Yepez was convicted of second-degree murder in 2015 for the 2012 beating death of 75-year-old George Ortiz of Santa Fe.

I am aghast this was even proposed as a defense. If it was allowed EVERYONE convicted of ANY violence could say that.

I expect it to succeed in California any day now. Maybe Dallas County under the new DA who does not believe in prosecuting crimes (lazy bastard).

Quite different. This is more like phrenology. Insanity defense requires proving defendant did not possess mens reas. But the “why” is always sui genre.

In this case they are saying the gene removes mens reas just by existing.

Huge difference.

Several years ago in Georgia, a man was claiming that he was genetically predisposed to commit murder. His defense attorney had a family tree chart showing that the guy’s father had murdered someone, one of his grandfathers had murdered someone and that there were other murderers scattered throughout his family tree. The theory was that he shouldn’t be held responsible for killing someone because it was in his genes to do so.

He was found guilty of murder in spite of their chart.
