Let's get real Pence could not give the Presidency to Trump

Posted on 01/12/2021 7:30:24 PM PST by springwater13

A couple things would have happened if Pence unilaterally ignored the election results in the Senate.

1) The Democrats would immediately sue and it would go before the Supreme Court within 24 hours and overturned. Even a Republican Majority could not allow it as it would create the Precedent of any future Democrat Vice President being given the authority to unilaterally void an electoral college and Congressional certification vote. It was always a ludicrous argument.

2) Pence would be promptly impeached by Pelosi and likely would have to resign or face a Senate trial.

The only thing it may have done was stop the riot and insurrection and make Pence a folk hero to millions and likely 2024 front runner in the primary. It wouldn't have given Trump a second term though.

There is absolutely nothing in the Constitution saying the Electoral Votes must be counted on January 6th.

There is in law. That can't be overturned by fiat. It takes a change to the law or a court ruling striking the law down.

This would have been the right thing to do and there is precedence for it in the 1877 POTUS election Electoral dispute between candidates Tilden - Hayes.

About 10 years later Congress passed a law outlining the process for counting the votes from the Electoral College and by law January 6th was set as the date to do that. Pence can't ignore that.

No, I did see that you said SEVEN states but you also referenced TWO competing slates of electors. I was simply asking which states certified more than one slate. Got an answer?

BULL to your BULL. Jay Sekulow, who - gee - I think is a pretty good constitutional attorney - said: "Some have speculated that the vice president could simply say, 'I'm not going to accept these electors,' that he has the authority to do that under the Constitution. I actually don't think that's what the Constitution has in mind, If that were the case, any vice president could refuse any election," he added. "It's more of ministerial procedural function."

But what does a man who many considered for the SCOTUS know over you?
